I am about to tackle HSBC for £1732 but am a little worried about what to do if they decide to take it to court. I know most settle before then but you are always worried that the first is going to be you. So what happens or what do you do once you get there? And would I have to appear in a small claims court of their choice so could be London or who knows where. It not going to stop me at mo but may make me pause later.

Not sure about the what to do in court as not got there yet, but the small claims court used would be your local court as you are the claimant and they are the defendant...

My claim letter sent in to Lloyds, and have received letter addressed to both myself and my husband from Customer services recovery saying sorry about your complaint! this is my claim only , he has never banked with Lloyds ever, I thought the data protection act forbade this type of thing.

    Hi all.

I sent a letter off to LloydsTSB 10 days ago, asking for £587.66 back in charges, today I recieved a letter back from basically saying they are investigating the claim and they hope to be completed within 2 weeks. However they also state it could be up to eight weeks.

Should I initiate letter two now or wait for another two weeks?

The general consensus is to stick to your own timetable.
    Good luck :)

    Hi

If you sent it recorded delivery, you will be able to find out through Royal Mail online services the date they received it, keep a note of it. Personally, I would send a further letter saying something like, 'for your reference the letter sent on xx/xx/xx should have been dated xx/xx/xx but you note that they received it on xx/xx/xx.' just to cover yourself. But I would still keep to the same timescales. You could probably get hold of a fax number if you ring the bank (which one?) - that way you'll know that they've had that letter too.

Thanks Lou, I didn't send it by recorded delivery either. I think i'll re send it like you said and also send it by fax, nice idea that. The halifax bank is the one reclaiming from.

Again thanks for your reponse, much appreciated.

No this would be more than likely be classed as a service fee, since it was for a service provided, not a penalty.
