Oh right - I understood it like we couldn't claim back the overdraft interest etc, but we could charge the banks interest on the charges they had made us pay0

I'm sorry, I'm VERY confused. I've been looking through my statements and I do have about £200 worth of charges for being overdrawn etc. BUT I've also got about £300 worth of interest they've lumped me with because they let me go over my overdraft, can I claim for those?0

You have to work out what proportion of those overdraft interest charges are interest charged on the unlawful penalty charges. You can't claim it all back. I used a good spreadsheet but I think you have to register else where to access it. I'll see if I can get a link for you.
You can also charge the bank interest on the charges -- either at the statutory 8% which kicks in once you file in court - or a contractual interest rate which is a bit complicated and unproven ths far.LegalBeagles0 -

£2,157.63 back from Halifax - bank charges plus interest, and it only took two letters (one to get my last 6 years of statements, 30 minutes on Interest Calculator, plus one letter to ask for all the money) - Wow!

After i wrote my first letter to the Alliance & Leicester asking for my money back (£145.00) they sent me the standard letter "charges correct blah blah blah but as a good will gesture refunded me back £68.
I wrote the second letter "not satisfied" and strangely i received another letter saying "we've considered your complaint .... not refunding you the money" but when I checked my account they had refunded the rest of the money I asked for. Obviously didnt respond to their second letter, I've got my money.
I know its only a small amount but I'm dead chuffed!!
I'm going after the Halifax now, but their asking me to give them 8 weeks to investigate my complaint, guess what no why!!!

cannot belive it. i sent one letter asking for my money back. i was all prepared for a long wait. today i recived a letter offering £1420. i am going to take this. thanks to all x x0 -
Alliance & Leicester:
Amount Claimed £3, 629.80
Amount Paid £3, 600.
Had three years statements, didnt want to apply for the rest in case they dragged it out, and the OFT made a judgement in between.
01.02.07: Sent First Letter, standard reply, fobbed off etc
08.02.07: Sent second letter, again fobbed off.
28.02.07: Sent final demand, included interest and a court claim form detailing particulars of claim(although as I hadn't yet filed it, it wasnt stamped) Offered to waive the interest for immediate settlement

Offered £3,600.. Just dont give in to these people.. no better that loan sharks.:beer: will be paying off CC and having a large one!!0 -
Hi all,
Just a quick question. I am trying to recalim my charges from Barclays. I have sent the letter asking for x amount of money back. They have replied today to say they are sorry i am unhappy and are looking into the matter, and will get back to me before 29/03/07. Does anyone know if this is a usual delay tactic, and have any ideas as wether i shoudl wait or press on????
