I'm confused. My claim (MCOL) was "deemed to have been served" on Barclays on Feb 10th. Barclays had until Feb 24 to reply but since they filed an "acknowledgement of service" their time was increased to "28 days from the date of service"
I calculated this to be March 10th and since no defence has been entered I attempted to have judgement by default entered yesterday the 10th March. The MCOL site would not let me do this so I assumed perhaps the 28th day has to have come and gone. However I still cant do this today the 11th. By my reckoning 28 daYS have passed. Either my maths is screwy or something else is going on. Can anyone help please?
This probably wont be much help but i think your right. So i dont know whats going on, you should call MCOL on Monday.0 -
Gillsy,
Just a personal opinion but I find that an astonishing charge. I simply don't see how they could defend it. You have every right to have access to your own money until every penny is gone. By applying this charge they are speeding the process of reaching NIL ballance.0 -
Hi All,
I recieved a letter from Nat West telling me they had passed my last letter requesting they repay my charges to their "Customer Relations Unit" & i will be hearing from them in the next 10 days.
I've decided this is probably just one of the delaying tactics they use & have written back telling then this is very unsatisfactory & will be proceding with court action to reclaim my money back from them.
Has anyone else had this, did they contact you within 10 days? did they pay up? or tell you you were wrong? is it all to delay things?
I'm going to put my claim into MCOL on Monday.
they are quick enough to take our money, but don't like to give it back !!0 -
From MCOL FAQ...
I am entering judgment by default but a message comes up stating you cannot enter judgment by default at this time, why does it say this?
A. This is because the defendant's time for filing a response has not yet passed. If their deadline fell on a weekend or bank holiday they are given the next working day to respond. It may also be because the defendant has filed an acknowledgement of service, which gives them an extra 14 days to respond.

Hi,
I'm a newbie and trying to reclaim charges from Coventry BS.
They sent me 6 years statements for 2 accounts straight away (don't know if they have cashed my cheque yet so quick!)
Could anyone advise if I can reclaim 'Low balance Auto Charge' fees?
This fee was charged every time I withdrew cash when my balance was under £100. I have actually advised in my 2nd letter that these fees were unlawful as I didn't cost the Coventry anything when I withdrawed funds when my account had less than £100 and tried to reclaim them along with unpaid dd fees.
Can anyone advise??
Thanks0 -

Thanks for that Edinburghlass, I have allowed the full 28 days to pass but it does indeed fall on a weekend. How thoughtful of the MCOL to do this (even though I've been charged for going overdrawn on a weekend)
I'll give this another crack at one minute past midnight which will be Monday and hope that the MCOL system does not allow for the fact that Mr Barclays is still in bed and has not arrived for work yet.0 -

Probably the customer is asked to keep a certain amount of money in their account in one month to gain interest as it is a building society.0 -

I logged on this morning to ask exactly the same question! However, I received my Notice of Issue yesterday (I submitted the court papers last week), and since submitting I have been charged another £90 in referrals and 2 £35's for return of a direct debit - can I claim these back, or will I have to start the whole process again.
Hopefully if, (when) I get my total charges refunded it will put me back into the black and then some, so no further charges will be incurred. But I don't see why they should get away with these charges incurred since filing.
How do I recover these charges please?0 -
