As regards claiming the interest charges on your overdraft you would then have to work out what percentage of the interest was due to charges and what was due to your normal spending.
Thanks for your quick responses - your a star.
After hearing of the problems that others are having, and your sensible responses, my letter of acceptance is on its way.
Chuffed to bits  Cheers!!

Wrote 14 day letter and received a cheque refunding my charges. Painless and all it cost me was 20 mins and a stamp !!
If you are reading this and don't believe YOU can do it, think again.
Am expecting a payout from A&L in the next week or two. Thanks to MSE I cleared £37k of debt in five years and I was lucky enough to meet Martin to thank him personally.0 -
I TOO AVE HAD THAT LETTER AND DONT KNOW WHAT TO DO HOPE SOMEONE CAN HELP
Sounds like they are holding out for the Office of fair trading report, which it is suggested as been agreed with the banks.
I intend sticking to the timescales set, to get in before the ruling. I intend filing against Lloyds TSB today, 7 days after giving them a final chance.0 -
Thanks for the reply!
I have another question if you know. Once I receive the bank statements in about 30 days wohoo, will it be too late to continue the process with the maybe new bank charges policy that will be discussed in April?
Am prepared to spend time disputing but I don't want to start all this for nothing if it will be too late!0 -
Sent the initial standard letter with my £10 cheque to my local Natwest about a month ago.
This morning the postman gave me two large envelopes containing all my bank staments of the last 6 years. There's no other letter or documentation in either envelope.
Is that all I should expect to get? Do I have to work it all out myself?
Any advice would be greatly appreciated!
Martin has added a calculator.
Go though your statements page by page, and type in the amount and date of every charge in turn. For each charge, click calculate, and then add to list.
At the end, you can print off all the charges, interest and their totals.

By the time you get your statements, there should have been a ruling by the Office fo fair trading. Martin expects them to recommend a charge of around £12 per item, so you will be still able to claim the difference for each charge.
Personally, i think the new charges should start from April, and that the previous charges should still be declared illegal.
Nothing is set in stone at the moment, as nobody know for definate what the OFT will say, but i am sure you will be informed on this site, whether to still proceed.
Get your statements, and take it from there, based on the information available at the time.0 -
Hi all,
Tips on what to do next please. I am claiming approx £910 worth of charges on 2 cards. It would be interesting to know if anyone has had any joy getting Amex to cough up! ... Here's what Amex say:
I refer to your letter concerning the default charges levied to your account.
American Express maintains that our charges are fair and reasonable and are avoidable by complying with the t&c's of our agreement with you.
In light og the OFT recommendation American Express has changed the charging policy with respect to default payments. Our charges vary according to product and account type and reflect the differing risks accociated with each. The changes were applicable from 1st July 2006 and our previous default charges will not be amended.
We have informed the OFT that our default charges will be £8 on credit cards. This reflects the costs involved in administering accounts in default, and is calculated in accordance with the guidance issued by the OFT on how to calculate default charges.
We have informed the OFT that our default charges will be £10 on charges cards. This reflects the costs involved in administering accounts in default, and is calculated in accordance with the guidance issued by the OFT in how to calculate default charges. This reflects an amount reflecting the additional cost to us of funding borrowing on the customer's behalf whilst they are in breach of their payment obligations. I trust this clarifies the situation"
Further to this i have since been offered £250 as full & final. Amex waffling on about OFT guidlines ... i really want the full amount ... do you think i have a chance out there?"onwards & upwards"0 -
Bank Natwest
Amount claimed £2729.38 + £797.46 interest
Amont recieved £2729.38 without filing at court.
This was an usunsed account, and they made an offer after recieving my first letter.
I'm about to tackle Lloyds TSB, which is my current bank account provider. They have refused to pay. I have opened an account with another bank, just in case they throw me out. Filing with courts this week, unless an offer is made.
With £2729.38 under my belt, the stress of reclaiming is gone, and any more recieved is a bonus.0 -

Can everyone please read carefully Martin's thread about the Impact of OFT.
