kp - You don't need to do anything, HSBC have acknowledged your claim and state they intend to defend (they almost certainly won't!) and therefore have 28 days in which to file their defence. The court will advise you if they file a defence and will forward necessary papers for you to complete. In my experience (and many others) you'll receive some sort of offer prior to the 28 days coming up. If HSBC do nothing, in 28 days you can request judgement and get your mone anyway.

So just hang in there for now! Lou

Thanks Lou, got a reply from MCOL today saying Nationwide will be submitting a defence to my claim for £166. Was wondereing what to do now, since last letter from MCOL gave me 14 days. Pete the newby!

    Bank: Nationwide
Amount Claimed: £1149.59 (including interest and court fee)
    Amount Received: £1149.59

    The Story:
Started back in October, but had to put a halt while i opened another account. Restarted it at the end of January, followed the MSE guides, sent all letters, but to no avail. Filed with MCOL on the 12th of February, received confirmation and intention to defend dated the 13th. Nothing else heard from them in the last 4 weeks, then checked my online banking today ot find they have paid the whole lot! Thanks so much to all that have helped and given advice!

    Story:
Just followed the tried and tested method of reclaiming charges via the templates, and with the valued advice from this site and from penaltycharges.co.uk. • Hi Guys,

I have a funny one I don't think has been covered previously. A friend of mine is particularly poor with managing her money. In the past she has incurred a lot of bank charges. At one point, she did not pay these so they sat as unarranged overdraft. She continued not to pay and eventually had a County Court Judgement issued against her. She is now paying over a number of months. I am just wondering whether the County Court Judgement could be overturned on the basis that the charges were essentially illegal and whether the amount owing would be written off and amounts paid refunded to her? There may be further complications with this as I don't know the full story but on this basis does anyone have any idea where she stands?

Just hang in there for a bit longer - I think you'll get some positive news before day 28. Good things come to those who wait... apparently!

Read Martin's article and then read post 4 in the Reclaim Help Thread for what you can and can't claim. Both are linked in my signature.

As rule any monies reclaimed will be paid towards the account with the debt.
