Please don't use this thread for general discussion on reclaiming bank charges.
Nat West Bank
Reclaimed : Total with Interest £3669- 80
Paid Back £3669-80
Started November 06 with first letter, no response, second letter received standard letter reply, threatened to take them to court, no response. Took them to court. They put in defence and sent me a Request for further information and clarification. This was rather intimidating as I was now dealing with their solicitors and was worried I may give them a loophole to ask for the claim to be struck out. I then remembered that the brunt of those charges was taken from my disability benefits when I was fighting cancer and didn't know if I would live or die, and when I told them at the time they had no sympathy at all , and sucked up all my benefits week after week. This made me determined to fight to the end. I answered their request and filed the court allocation questionaire. Two weeks ago I received a court date for May 24th. Today I received a settlement cheque for the full amount.
I would like to say thankyou so much to this site, I would never have done this if I hadn't first seen Martin on GMTV and then found this site. I would also like to point out that when you get as far as the Bank putting in a defence there is not any further help and you feel alone and like giving up, if any one else gets into this situation it may be a good idea to look at a little further help. Also although it is stated that anyone on benefits should not give a donation to the site, I really would like to give a little something when my cheque clears although it may not be a lot, I would like to show my appreciation as I thought that money was lost forever. Thank you so much.0 -
Three weeks back put in the initial claim for £1844.00 to Halifax. Received reply stating that under terms laid dowm by FSA that they had 8 weeks to reply. Waited, then today a letter arrived from them stating that they would happily refund all costs, however this was not an admission of liability. They told me that they were offering free banking and that my actions in going overdrawn were those of a naughty person! Additionally they have stated that any further charges would not be refunded and may result in my account being closed!
All in all a very good result, no need for court threats as letter number 2 was quite sufficient....patience is the game. Thanks for your guidance and good luck to all those others claiming charges.
Claimed: £1844.00 Halifax paid £1844.00 no fight, have more aggro from my puppy!:T0 -
They then CCJ'd me with the total coming out with costs at £2079!!. Can I still try and get the charges applied to the account refunded? and does anyone know if you can defend a CCJ application in these circumstances....ie dispute the amount owed due to the addition of unlawful charges? I know its too late for me to defend the CCJ but for other people in a similar situation facing a CCJ I thought perhaps that the banks might back down if faced with revealing their true costs?! Any insight anyone has would be greatfully appreciated!!!
Special thanks to Martin et all for the great site!!

You can add in charges up until you file a claim at court.0 -
I'm confused. My claim (MCOL) was "deemed to have been served" on Barclays on Feb 10th. Barclays had until Feb 24 to reply but since they filed an "acknowledgement of service" their time was increased to "28 days from the date of service"
I calculated this to be March 10th and since no defence has been entered I attempted to have judgement by default entered yesterday the 10th March. The MCOL site would not let me do this so I assumed perhaps the 28th day has to have come and gone. However I still cant do this today the 11th. By my reckoning 28 daYS have passed. Either my maths is screwy or something else is going on. Can anyone help please?0 -
First Direct
Claimed: £75
Paid: £85 (?!?)
Basically I went over my statements on the internet, as I was sure I had a few charges going back a couple of years. Sure enough I found them, amounting to £75 on two occasions for going into an unauthorised overdraft by less than a tenner.
I sent them an email along the lines of Martin's first letter (just over 2 weeks ago), asking for a refund. They responded the next day, stating they were looking into it and would get back to me.
They called on Weds just gone trying to flog me a loan (refused) but I took the opportunity to ask what was going on, they said they would get back to me but didn't.
Logged on to account this morning intending to move to stage two, checked balance....and they have put £85 quid into it, entitled charge refund!!! Yay!!! :j no idea why it's more than I asked for but I'm not complaining!
I went to a finance seminar at work this week, and they advisor said if you have had charges then claim them back, it's unlikely they are going to let a case get to court because a ruling against them will really open the floodgates.
All thats left to do now is transfer the money to my FD credit card to offset against the neg balance......:rotfl:I have had many Light Bulb Moments. The trouble is someone keeps turning the bulb off

Hi,
I'm a newbie and trying to reclaim charges from Coventry BS.
They sent me 6 years statements for 2 accounts straight away (don't know if they have cashed my cheque yet so quick!)
Could anyone advise if I can reclaim 'Low balance Auto Charge' fees?
This fee was charged every time I withdrew cash when my balance was under £100. I have actually advised in my 2nd letter that these fees were unlawful as I didn't cost the Coventry anything when I withdrawed funds when my account had less than £100 and tried to reclaim them along with unpaid dd fees.
Can anyone advise??
Thanks0
