I am going through the process of reclaiming back charges from Lloyds TSB The bank have sent a counter claim stating 'The particulars do not comply with rule 16.4(a) of the civil proceedures rules as (amongst other things) I do not identify the account in question or how the sum in question is arrived at. In all my correspondance with the bank I have stated the accounts in question but have lumped all the charges together totalling £4313.07. Is this the bank trying to put the frighteners on me through the courts or have I done this incorrectly. Has anyone else had this experience....HELP!!

    Hi Mingra6,

I think you'll find that you should list each charge individually along the lines of charge description, date, amount of charge, interest(if claiming) and total amount (charge plus interest) on either a spreadsheet on using the calculator in the reclaim charges item..

Even if you have two or three charges on the same day must be listed individually......

today saying that under FSA rules they have 8 weeks to deal with my complaint. I don't want to wait 8 weeks and then get fobbed off again. What should I do? - send another letter demanding a settlement or I'll take court action? - or it that likely to be met with an 8 week reply letter also?

You don't say what letters you have sent, but stick to your timescales, 1st letter giving 14 days then 2nd giving another 7 days then file on mcol. this is not a complaint you are just requesting the return of monies you consider unlawfully removed from you account...

Hi i am new to this so will have to bear with me ,i am thinking about claiming penalty charges from the halifax but keep putting it off ,has anyone had bad experience with this bank ,i do not want them closing my account .

Sticky - i claimed - and won a lot from Halifax group - they did not ask me to close my account. If you read the thread on Halifax/HBOS claims (do a search in the Forum) I don't think you'll find a single customer that has yet been asked to close their account. However, I did open a Lloyds TSB account online to use just in case and Martin does advise opening a parachute account just in case...

Go for it - Halifax ARE paying out a lot...

    Hi there,

    Bank: Halifax
    Amount claimed: £278.80 (including interest)
    Amount received: £278.80
Time taken: Just over 2 weeks
    Letters written: 2

Although this amount might seem small, I have only had this account for 2 years, and was incensed when I was recently charged £120 for going overdrawn with three tiny transactions of less than £10 each. I have a mortgage with HBOS group, so was pretty sure they wouldn't be cavalier enough to close my account.

I sent the first letter to my local branch in Banstead, Surrey, and received an immediate reply (as you said I would) saying that they couldn't refund, and it was only fair that us naughty overdrawn people bore the costs etc. It was also a little bit confusing, as despite saying this, the local bank manager also said they were referring the complaint on to their central customer service department. 14 days after the first, I sent the second letter threatening legal action, and received a letter offering the full refund 2 days later.

Top tip - send the letters recorded delivery so they know you mean business, even if you go into the bank every day. Then there can be no doubt that they've received them.

Needless to say, I am absolutely delighted. Thank you Money Saving Expert!

    I claimed £1194 (£1000 charges and £94 interest)

Have had a letter this morning offering £854.00. However I want the whole £1000 as an extra £150 would come in useful. Do I ring them and tell them I want it all or do I have to send another letter. I am quite desperate for the money so the quickest option would be great

Try giving them a ring say that you are prepared to forget the interest if they up the offer to 1000... As Martin say's in his video it's a negotiation in the end...
