Banks has 14 days to acknowledge which gives them a further 14 days (28 days total) to file their defence. However, my (successful) claims against HBOS saw them acknowledging on day 15 which cancelled out my request for judgement.
So, if you don't hear 14 days after date of service (a few days after you issued) apply for judgement anyway. If they acknowledge you'll have to wait another 14 days before you can apply again - because it's highly unlikely they'll file a defence at all.

hi i have a problem that i wondered if anyone can help with i had a capital one card in dec 2004 went over my limit and got a call from them to pay the arrears back which i set up a dd for 80 for 3 months. i changed address and informed them headr nothing about this account until jan this year when i checked my bank statement a dd has been going out for the last 2 years! i called capital one changed address again and still nothing so i calld last week got it sorted and got my 7 last previous statements the balance is 375 with a 200 limit. they have been taking 18.00 by dd then charging me 12.00 charges every month and some months 2 20.00 charges what can i do?0

Hi Paul - i left out the name of the court as the letter is grammatically correct without it. (It worked - I won anyway). If you're using MCOL you will be using Northampton County Court although the court may be transferred nearer to you in the event of it going further...
My advice would be to leave the name of court out, but I am sure you will receive further replies if necessary.

Put in my claim letter today to my local BOS, thought I would hand deliver, I went straight to the bank employee who with a lovely smile asked if she could help? I gave her the envelope and said I wished to hand deliver it rather than it getting lost in the post. I was then asked what it concerned and I answered that it was a reclaim form for my bank charges. Well no longer the nice smiling employee but a scowling old dragon whose flames were burning right through my eyes and with a gruff goodbye off she went. Was made to feel like !!!!!! Turpin, I have been real nice with the bank as way up north here in Inverness you get to know most of the staff but from now on It's just buisness. Claim was for £1160 and will not settle for less Raging mad:mad: :mad:BORN TO RIDE - FORCED TO DRIVE

Hi, please can someone tell me whether the 40 days that you give the bank in the first letter is 40 working days or just 40 days?
My bank (Lloyds) have replied saying it was 4 weeks since my letter (Step 1) and it will take a further 4 weeks 'atleast' before they give me the list of default charges.
Do they always take this long or are they trying to drag it out until the OFT ruling?0 -
I am going through the process of reclaiming back charges from Lloyds TSB The bank have sent a counter claim stating 'The particulars do not comply with rule 16.4(a) of the civil proceedures rules as (amongst other things) I do not identify the account in question or how the sum in question is arrived at. In all my correspondance with the bank I have stated the accounts in question but have lumped all the charges together totalling £4313.07. Is this the bank trying to put the frighteners on me through the courts or have I done this incorrectly. Has anyone else had this experience....HELP!!0

Hi i am new to this so will have to bear with me ,i am thinking about claiming penalty charges from the halifax but keep putting it off ,has anyone had bad experience with this bank ,i do not want them closing my account .0
