From reading this discussion area avidly for the last three months or so, It seems that the banks generally are stalling much more now - do we think they are trying to string it out till the OFT makes its report and recommendations?0

Bank: Royal Bank of Scotland
Amount Reclaimed: £1144
Amount they paid: £1144
The story: Requested statements, received them a week later, calculated all my charges, sent first letter (without claiming interest)... waited three weeks... printed out court action letter but then received two pager from RBS that very day saying blah blah admit no liability, we're right, you're wrong HOWEVER please accept £1144 as a gesture of goodwill. Erm, OK then!
Thanks everyone for inspiring me to do this and good luck to everyone else who's trying. It's worth the effort - I now have no overdraft!

Bank: Nat West
Amount reclaimed: £3,500
Amount paid; £3,500
They don't accept responsibility but full amount paid into account within the time limits. They didn't close the account. Thank you Martin!!0 -
I think I have seen a thread which tells you the name of the bank for putting on court form. I need the Nat West address and have been given different ones from Nat West. Appreciate being pointed in right direction for this please. Also I started getting the online form ready the other night and was going to use the Particulars from this site but there are too many characters for the online form - has anyone else had this problem. Not sure what to leave off to fit this onto the form - help!Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!
HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.
Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA0 -

It would seem that way. I chased up HSBC today for repayment of default
charges on my credit card, they hadn't replied to my threat of court action dated 13th February. They are hiding behind the FSA ruling that they have
8 weeks to deal with a complaint. I explained that my situation and thousands of others was not a complaint, merely a claim for unfair charges
and that it was very wrong of the Banks/Credit Card compnanies to hide behind that ruling.
Maybe this needs to be looked into by Martin.0 -
Have decided the time has come to fight against my bank having just this week cleared off my student over draft at a whopping 200 per month.
Could anyone tell me if it is legitimate to try to claim bank charges back for when i purposely and knowingly went overdrawn ie wrote cheques to a cash till pay day service, knowing I had no funds in the account but they would clear anyway? got charged shed loads for the 4 fours years i was at uni, not all my fault i may add.
anyone successfully claimed these charges back?
Any advice would be most welcome
Ps. was with halifax at the time (i detest them)0 -
also, not sure if i have posted this in right area - again any advice would be welcom0

HSBC
Amount claimed £2451
Amount recieved £2651
We have been fighting to claim this since June 06 and we finally got there. They offered us initially £1960 but we held out for the full amount.
Now we need to work on Lloyds.0 -

You need to read Martin's article then read it again for good measure. Check post 4 in the Reclaim Help Thread for what you can claim, both are linked to in my signature.0
