    I've gone through all the stages for claiming my money back from HSBC and had gotten to the court claim. Now HSBC have said they will defend the claim and I'm scared!! What's going to happen and should I be worrried?:eek:

    I need to get my claim done, been leaving it too long now! I don't expect I'll get much but its worth a try. Just a quick question, using the letter templates can I ask for my bank and credit card charges back, or would this need to be done in seperate letters?

    Also if I want to know my charges, will the £10 cheque cover both my credit card and bank account, or would I need to send two cheques? My credit card is mastercard and my bank account natwest.

    Any advice gratefully received!

    One cheque, one letter if the accounts are with the same bank.

    Amount received £1100

    Started the procedure back in sept last year, got my statements through the post exactly 6 weeks later.
    Filed a claim for £1137 (didnt bother with the interest)
    Received a letter 6 weeks later saying "our charges are fair"
    Sent a "I'm gonna take you to court" letter.
    Received a letter end of January saying they will look into the matter.
    Received a letter yesterday saying "our charges are fair" (again) but as an act of good will they will refund me £1100!

    Also just got my statements from Lloyds TSB - another £600 to claim (hopefully) :D

    I'm not really irresponsible with my money :rolleyes: - these charges arose when I was working a minimum wage job taking in £500 pm after tax!
    So I've been doing some volunteer work for the
    samaritans.
    Tried to phone in sick the other day but
    they talked me out of it.

    The story: I have a student account with Lloyds and have had it for abut 4 years, within that time they've charged me for going over limit, bounced cheques etc. They whacked me particuarly hard over Christmas at which point I'd decided I'd had enough and was going t do something about it. This is what I did:

    1. I sent them a letter telling them in no uncertain terms to refund my charges or court action would follow.
    2. Got usual nonsense reply back. I filed claim online (note no second letter) on hmcs site.
    3. Lloyds filed an acknowledgement of service, and eventually a defence.
    4. I returned my court allocation questionnaire. About a week after doing so, they paid the money (without any warning) straight into my Lloyds account in full!!! I nearly fell off my chair! Whole process to about a month!!!

    For anyone suing Lloyds they'll take it all the way up to the CAQ, but don't be scared its pure posturing on their part, they're simply enagaging in scaremongering and cynical tactics in an attempt to put people off!!!

    Just want to say Martin I really admire you for putting this site together its a superb resource. I heard you on the BBC Moneybox programme on Radio 4, your positive attitude really inspired me. I'm only 23 and got a bit scared at one point when they filed a defence, but you were spot on in your video!! If you're ever round the Euston Road pop in The Rocket pub and I'll get you a beer (or three!) Thanks ever so much mate, you're a true inspiration. I'm now repeating the process with Nationwide.     hi all would just like to say thanks ive have this morning recieved a letter from hsbc offering me 845 from a claim of 995 so really happy as gonna accept put it towards my wedding
  • Apologies if this has been raised before. Can late payment charges be claimed back on cards such as AMEX (here the amount has to be cleared every month)?

    A few questions for everyone, please!

    1. Are many banks actually forcing people to close accounts after a claim, or just using the threat of closure in an attempt to twist arms?

    Some bank are closing accounts, Nationwide is one.

    2. If I successfully reclaim charges on a current account with an outstanding overdraft, and they then close the account, I presume they'll want that overdraft repaid? If the charges are less than the overdraft, and I can't pay back the difference, that means I might not be able to 'afford' to claim back the charges?! :-/

    Some banks will withdraw an overdraft.

    3. Anyone tried this on a business account?! Also have one with one of the major high street banks...

    Yes you can claim some charges on a business account, similar to a personal account.

    4. If this OFT ruling is coming soon, is there now 'time' to begin a full-reclaim process? Maybe they'll just ignore the letter for a few weeks, then say .., etc.

    Even with the OFT ruling looming you can still make a claim.

    Yes, change the wording in the template letter to read you are claiming late payment fees and/or over limit fees.

    I am thinking of reclaiming bank charges from the halifax probley about 4000 but am scared to do so, as my wages go in the account. I have a o/d of £400 and two large loans with them, I also have a credit card with a balance of £1400 any ideas please
    1400 to cedit card now 1367:D
