  • Hi all. I wonder if anyone can help me. My husband and I have sent a letter from the templates on the website to Natwest to reclaim our charges back which total to £2500 more or less. Natwest have responded by letter (althought the letter was addressed just to my husband and its a joint account and they spelt our surname wrong!!!) saying that they will be in contact to resolve the matter but also provided a free phone number to call if we wanted to contact them regarding the charges. This I did and got no joy! They said that the case was being sent up to them and they didn't have the details yet and also that it was going to take upto 8 weeks for them to process the complaint. Is this acceptable?? I don't feel that it is and my husband feels that they are stalling due to the new regs that might be put in place soon. Where do we go from here?? They have had their 2 weeks notice to deal with this. Do we now go to the next step and threaten court action? Someone please help!!!

Personally I would stick to your own timescales. I have through this with various banks and its done me no harm.

    Good luck :D

    Advice please peeps!

Sent my first (14 day) letter inadvertently to HSBC Canada Square (statements address) recorded delivery but sent my 7 day letter to the correct address in Leeds. I rang to check progress today and they said they hadn't had the first one but that a reply to my second letter would be within me 'soon' with a follow-up later promising action in a few weeks or so.

If i stick to my timescales I should be going to MCOL tomorrow but I don't want to jeopardise the flow of proceedings later if I sent letter 1 to wrong address. But, does the fact that this was sent recorded delivery and received by HSBC in Canada Square still mean they were 'served' correctly?

    Thanks for your help. Lou.

  • Are we running out of time to get our claims in and sorted - .

Heard something about a new ruling coming in in April....I want my money back!! It would be just my luck to lose out...!!

The OFT ruling will make no difference whatsoever.... so i wouldn't worry about it to be honest.

    Hiya all.

I've another week to go before the 40 day 'deadline' is up from sending the 1st letter to the Halifax as advised in the template letter.

What if they do not reply ?

Do i send the 2nd letter anyway, and if so how much do i say i am reclaiming ?

    thanks in advance

    kindest regards
  • No of course you don't... Guessing your charges is a dangerous game. They will reply.. if not, a quick call does the trick or a second letter threatening to take them to court for non compliance...

Send them another letter saying they have failed to comply with the 40 days and you are giving them a further 7 days notice to send your statements or you will pass your letters to the information commissioner

    Bank: Abbey National Plc
    Amount Reclaimed: £369.95
    Amount they paid:£377.38

The story: This all started back in October. I sent the first two letters, they then offered £80 which I refused. I then filed with moneyclaim, which they defended and this then meant that I had to fill in an AQ and send it back to the courts. I finally obtained the judge's order and a court date for 24th April. About two weeks ago I sent both abbey and the court my court bundle. Finally today they offered me the full amount by cheque. I have to say abbey are a tough bank to crack but they will pay eventually!!!
