    One week ago I started my claim (from template letters) with Halifax for two accounts, one just under 4,000 and the over 5,500. Today I have received a letter seperately for both stating they are sorry to hear I am unhappy with their charges and they have sent my letters to the Customer Relations Department. They have also stated they aim to get back to me 'within 4 weeks'. My initial request letter would have expired next week now I have to wait another 4 weeks!

    Is this delay tactics, should I continue as I would have done?

    Also on a seperate matter, last year, before we knew of all these proceedings, we argued with Halifax over a weeks worth of charges totalling 300.00. We had these returned but signed a document saying that we would not oppose any charges thereafter. Will this go against us? If it does, can we still apply for all the charges totalling 3,000 up to the month preceding that letter?

    I would really appreciate some advice.

  • I did a search but couldn't find the info I needed so just thought I'd ask.

    Who is it that set the limit to six years for claiming bank charges back, this may sound like a silly question but as you need to keep tax records for 10 years now (certainly if you're in business anyway) wouldn't it be fair to assume you could reclaim charges for this length of time just as the tax man would claim back tax.

    Hope someone can clear this up.

    what if within 40days the bank havnt replied with your request for a list of charges? you can't progress to letter 2 without it!! :confused:

    Hi everyone, just been reading up about the "court bundle". Haven't got to that stage yet, hopefully I won't, but its best to be prepared don't you think.
    Had a look at what you need to provide - some of it obvious, but where would one get the OFT statement summary, or the early day motion from house of parliment or relevant case law summary? I've had a look but for the life of me I can't find it. Anyone help this simpleton?

    The story:

    I requested copies of my bank statements in January, received them after about two weeks. Worked out my charges and posted the standard letter two days later took the HSBC two weeks to respond with a letter saying they would investigate. I waited another week and sent out the second letter giving them another chance to give the money back. ON Sunday night I came home to find a letter from the bank saying they would investigate by 28th March 2007 (wasn't happy about that as it was another month I had to wait) This evening (6th Feb 2007) I received another letter from HSBC stating they have investigated my claim initially for £1982.36, £1548.50 without interest and made an offer of £1316.00. After three phone calls to my finiacial advisors (my mum, sister and best friend) we decided that I should take the offer due to me being seriously skint! The letter from HSBC did make me chuckle somewhat, and I quote;

    'If your claim for a refund proceeded to Court, we therefore believe we would successfully resist any legal challenge in relation to these fees.'

    I am now left wondering on what basis they can make such a claim since there has been no precedent set so far!

    I have now signed my letter and shall be hand delivering it before work tomorrow morning in the vain hope they pay up before my daughters sixth birthday next Wednesday :bdaycake:
  • Are we running out of time to get our claims in and sorted - on letter two (threat to go to court) posted today with both American Express Blue card and my Halifax Current account.....?? £500 and £1940 respectively......

    Heard something about a new ruling coming in in April....I want my money back!! It would be just my luck to lose out...!!

    Basically going to give exactly 2 weeks after delivery confirmed then submit on line claim to county court for both.

    Got £650 back from Halifax Credit Card today (what I asked for) after second (threat to sue) letter and a quick telephone call haggling them up from an initial offer of £450.

    Any advice on the above greatly appreciated !!!!!!
  • Keep going with abbey its all a ploy luckily my husband had kept all his statements, the longer they leave it the more months drop off of the charges to be repayed from six plus years ago if applicable. Make an appointment with your branch bank manager and you may get some success you never know as funny enough my bank manager was on my side for my claims although he could not say that out loud!!!!

    Just a quickie and also MY FIRST POST !!!! :j

    I claimed £1007 + £39 court fee . The £1007 is including interest i calculated from this GREAT site :T

    Sent the 1st letter etc and got the usual get lost letter . Sent the 2nd with no reply . Applied to court ... got the date and then today got £750 put into my account under EX-GRATIA ........ no letter .... nothing .

    I have been claiming on behalf of my partner and trying to sort out her finances.
    After totalling charges from 72 statements I wrote to the bank who replied with a typical timewasting "Send us a breakdown of your charges"
    Surely a bank MUST keep records of what they charge their customers otherwise it is just THEFT.

    I sent a spreadsheet with a second letter to which they did not reply.
    I then made a claim through https://www.moneyclaim.gov.uk.
    Within four days they made an offer which I think is reasonable.

  • Personally I would not accept this as there is no statement of WHY they have paid you this money. At least call your bank and get them to put it in writing. Whether you consider the amount is fair is down to you but I would not. Go for at least £900
