I had to ask the same question... but here is the answer - you will need to send this letter:
Account number xxxxxxxxxxx
I sent a letter and £10 cheque on the (Date) requesting six years of bank statements as is my right under the Data Protection Act. I have been expecting copies of my statements within the 40 days stipulated under the D.P.A. As yet I have not received any correspondence from you.
By not supplying the information I requested, you have breached my rights under the D.P.A. You leave me with no alternative that if I do not receive copies of my bank statements within the next seven days, I will forward copies of my requests to the Information Commissioner.
I look forward to your timely response.
Find enclosed a copy of my original letter.

i've been claiming on behalf of my wife from HSBC and put a claim in on the 26th of january for £1938.71 which included £285.21 of interest.
anyway after receiving the 1st 'we are looking into it it' blah blah letter on the 3rd of feb proceeded with the 2nd letter giving them 7 days before we took it to court.after we hadn't heard anything on the 7th day i got her to give the service quality team a call and to ask them what was going on-unsuprisingly a rather harassed sounding man on the other end of the phone told her they were putting an offer together but due to the high volume of people applying for their money back (my heart bled it really did :rolleyes: ) could we put off sending the court letter and something would be with us in the next 10 days.
we decided we could wait another week and a bit before going down the court route and low and behold yesterday we got not 1 but 2 offers on the doormat :T
obviously they both said we accept no liabilty blah blah and the offer did not include anything for the interest which we expected anyway.so the 1st letter was offering us £1437 and then we opened the 2nd one to find we had now been offered £1497! tough decision which one to accept of course :rotfl:
anyway with a little calculation we worked out this was an offer for just over 90% of the capital amount we were claiming so will be accepting the offer with open hands.
it really was that easy and all for a bit of our time and £2.50 or so of recorded delivery mail.
that easy infact i am now helping 2 work collegues and a couple of family members to do exactly the same0 -
I just wanted to offer a big, big heartfelt 'THANK YOU' to Martin for first of all creating this site and secondly for the dedication he has to helping thousands, probably millions of people to save money and to have the courage to fight the larger corporations......after what seems to have been a long, long, process of first of all writing letters to my bank, then lodging court papers and also having to get over the thought of going to court after the bank said they would defend this case I can now confirm that I arrived home last night to find a letter from the banks solicitors offering me the FULL amount I had requested :j :j :j :j
I truly could not have done this without the help and advice offered on this site, or without the advice received from other forum members I know there are other sites out there that also offer help with the bank charges issue but I for one would never have found the courage to go ahead and take a bank to court had I not read the aticle on how to reclaim bank charges featured on this site. The template letters, statutory interest calculator etc are invaluable tools and without these I would not be in the position I find myself in now wherein I am now able to clear my credit card with the money soon to be recieved from my bank and will be debt free!
Aside from the bank charges this site is packed full of useful info on how to make every penny count......after all we all work hard for our money so its good when we can find a way to make it work hard for us.

Can I claim unfair charges from a closed bank account?
It is with Yorkshire Bank and has only been closed for 3 months.

Thats great thank you. They will owe me a fortune as they charge £8.00 per day in unautorised overdraft fee plus referall fees for returned payments. I'm typing template letter as we speak.

i'm just going forward with the judgement by default on money claim. it is now askin me it Interest since date of claim and rate. what do i do? is the date of claim the date when sent the 1st letter or started the online money claim?
and is the interest on the the amount i'm claiming for or just the interest on the interest if you know what i mean
