  • Hi.
    Can anyone tell me if it's only personal accounts you can claim back on or is it also business accounts. I had a small business which wasn't successful and over a period had a hugh amount of bank charges.

    Were it says..."and therefore the [INSERT NAME OF COURT] court will rule in my favour...." in Martins Template letter should I put Money Claim Online Court Or the name of my local county court, I will be using Moneyclaim. com but am a little confused how the system works at this stage?

  • Halifax Credit Card

    Charges - £800.
    I Claimed - £650 - wanted a quick result without court.
    paid out - £650

    Initially sent letter declining - blah blah our charges stand, blah blah.

    I Sent letter threatening court claim - sent reply offering £450 (representing half of total charges) "... as I am a valued card holder..."
    I telephoned very politely (on first name terms with the lady handling my enquiry, who incidentally was v friendly, not at all intimidating as you might think they would try to be) insisted I was standing my ground, accepting no less than the already reduced amount of £650, and they could have it their way and pay the whole lot plus my court charges if they wished.
    She spoke to her supervisor - then told me the max they could consider without escalating it was £650 - conveniently the amount I am asking for. Sorted.

    Amex Blue Card

    Charges - £665
    I am claiming - £500.

    Credited £65 today after first letter as the famous "goodwill gesture". Not enough goodwill I am afraid!

    Telephoned number on letter to executive office (fortunately in Brighton, not in Mumbai) BEWARE - she was surly and abrupt! I was unable to speak to person dealing with my 'case'.

    Sending another letter today requesting £500 (no less) or I will escalate it.

    Will keep you posted - presume result will be similar to Halifax C Card.

    31 envelopes arrived today from my Halifax Current account. Should be interesting collating charges on there!

    Thanks for such an encouraging site. Spread the word everyone - than banks have been creaming our money for too long. They now know the customer IS always right!

    Don't be embarassed as I was initially, circumstances change, things happen - in my case a forced change of job, reduced salary, etc and a year of VERY hard times and cruel charges which realistically took 2 yrs to recover from.
    I often went hungry as I was living off packet pasta in sauce as I couldn't afford food, and often walked to work hungry as I couldn't even afford the bus! Let alone petrol. That is criminal the banks put us in that position and with that in mind I am not settling for less than EVERY PENNY they took from me.

    Anyway, sob story over !! Go for it everyone...............

    GOING TO COURT.

    Hello,
    Was hoping someone might be able to help.....

    I've been receiving letters from the RBS's solicitors asking me to send them information that their client already has (eg. a list of charges, why I'm claiming and my account details). They've also said that I'm required to send them anything that I send to the court. I spoke to someone at MCOL who said that I don't actually have to.

    My question (and point) is that surely the list of charges etc. is held by their client (I sent RBS the list of charges on 2 occassions) and even if RBS had lost these, they have details of my account etc. Why do I keep receiving these letters, which I've found quite intimidating, asking me to send them this information when actually it is RBS who holds this information. The whole point of my court case is that I am merely acting on information sent by RBS to me (my bank statements).

    The solicitors have also requested that I send them my account details and previous correspondence I had with RBS over this matter. Again, I provided my bank details in the POC and surely their client, RBS will also have all the correspondence I sent to them.

    My question is, surely the solicitor should be contacting their own client to obtain this information?
  • I have just been on the phonw to lloyds tsb chasing up my first letter after 40 days, only to be told that the address i got from this iste is wrong, so i've now got another 40 days! THE CORRECT ADDRESS IS:

    Lloyds TSB
    125 Colmore Row
    Birmingham
    B3 3SR

    Please change this on your list, so someone else doesn't waste 40 days.

    Firstly congratulations on providing such a worthy service - I've started the process with A & L and will let you know how it goes.

    Secondly, I wondered whether this process applies to accounts which have already been closed. I held a Natwest account for a number of years which was eventually closed after financial difficulties led to persistent charging which in turn led to my overdraft going way over its limit. Could I reclaim these charges to pay off the debt that debt collectors are now pursuing me for?
    Also, are all types of charges covered by this process i.e. unpaid cheques?

    Can anyone help? I need the address to send my letter to the Royal Bank of Scotland claiming a refund for the charges incurred. I presume it must be different to the first letter for requesting the statments?
