You will need to ring MCOL helpdesk on 01604 619402. You will need your case number at hand to quote. They may need to remove the claim and resubmit.

Ireally need some help. I am trying to reclaim my bank charges from Barclays which total about £1850 including the court fees. I have just been given a court hearing date of 17th April and have to have all documents with the court by 1st April. I don't know what to do next. What do I need to send to the court? I have unfortunately lost my copy of the originla form I filled in online to start the court proceedings. is this a problem? What other documents do I need to get together and where do I find them? I am reallyscared now so would really appreciate anyones help. Should I contact the bank and give them one further chance of settling? I asked the judge for standard disclosure on my allocation questionnaire but I don't know if he's given it.
Please help me, i need to know what to do and quickly.
    Thanks
    Vikki

    1. I don't know what to do next. What do I need to send to the court?

You will need to submit your court bundle, which includes all communication between you and barclays and evidence that backs up that the charges are unfair. This takes a good few hours to complete so the earlier the better. You will need to send the bundle to the court and the bank's solicitors. The bundle can be found here. at the CAG forums. You will need to register with them first to be able to download the bundle.[/URL]

    2. I have unfortunately lost my copy of the originla form I filled in online to start the court proceedings. is this a problem?

No, login to the MCOL site and you can obtain a pdf file with the original claim on it. I dont really think you need it at this stage anyway, just make sure that you know all your deadlines with the courts etc etc

    3. What other documents do I need to get together and where do I find them?

    Answered in no. 1 above

    4. Should I contact the bank and give them one further chance of settling?

You can do this but you will need to negotiate with barclays solicitors as this has now gone to court stage. Their contact details are on the defence documents that you should have been sent by the courts.

    5. I asked the judge for standard disclosure on my allocation questionnaire but I don't know if he's given it.

You will need to type out the order requested by the judge on this site so people can have a look at what the judge is asking from you.

    Good luck!

    Bank; Halifax
    Amount reclaimed; £1,107
    Amount paid; £1,000

This was my mother who is absolutely overjoyed and feels indebted to you. She originally had an appointment at her local bank where she was told there was nothing she could do about it. I printed off the templates for her and she sent the letter and then had a face to face with staff at her local bank. They offered £700 to start with but she held out for £1,000 (which she was offered over the phone the very next day). She let the £107 go because she felt she probably was at fault for that amount.

    Claim: £2206
    Offered: £1941

Sent my first letter on the 4th December so it has taken a little while. Received the offer letter after about 6 phonecalls chasing it up on Saturday (3rd March) and the letter was dated 9th February!!! So they are obviously sitting on these offer letters for as long as possible. It had dragged on for long enough so I was glad to accept for the sake of £200!

Didn't have to go to court and didn't even send LBA as I knew from speaking on the phone they were dealing with it. I was also £300 over my overdraft when they offered me the settlement so DO NOT WORRY if your account isn't in order as it doesnt make any difference to your claim.

I faxed the offer letter this morning to speed up the process and they have acknowledged receipt and money will be paid within 7 days!

Thank you Martin - Glastonbury here I come!!!

I wrote to Barclays 7 days ago after no response from them to my letter asking for the return of my charges (I have gone through all the processes using the templates). I have completed the Moneyclaim form in up to the payment of court fees page. I am waiting to get home tonight to see if they have responded in the 7 days.

Question, if they have not responded and I press "go" tomorrow, £120 will be taken from my credit card for fees. If this does not go the distance to court, at what point does this figure get notified to Barclays to add to the figure I am claiming? Do I assume that if I pay the court fee, then it will go to their legal department/solicitors, and any settlement figure will include this £120?

    GOING TO COURT.

    Hello,
Was hoping someone might be able to help.....

I've been receiving letters from the RBS's solicitors asking me to send them information that their client already has (eg. a list of charges, why I'm claiming and my account details). They've also said that I'm required to send them anything that I send to the court. I spoke to someone at MCOL who said that I don't actually have to.

My question (and point) is that surely the list of charges etc. is held by their client (I sent RBS the list of charges on 2 occassions) and even if RBS had lost these, they have details of my account etc. Why do I keep receiving these letters, which I've found quite intimidating, asking me to send them this information when actually it is RBS who holds this information. The whole point of my court case is that I am merely acting on information sent by RBS to me (my bank statements).

The solicitors have also requested that I send them my account details and previous correspondence I had with RBS over this matter. Again, I provided my bank details in the POC and surely their client, RBS will also have all the correspondence I sent to them.

My question is, surely the solicitor should be contacting their own client to obtain this information?
