I'm just bitter because out of all the banks I chose to bank with, I chose the hardest damned one to squeeze money out of..lol0 -

When you say stalling have they gone over the 40 days? If they have send this letter now. Check out the Barclaycard thread as they seem the worst for saying they don't actually have the information on file etc etc
I wouldn't recommend putting in two claims in this way.0 -

Just a thought...
I know this is a scarey thing to do but surely after OFT's 'RECOMENDATION'S' the fundamental's of the claiming process remain unchanged, we are claiming what we percieve to be a unfair penalty and not proportionate to the cost incurred by the banks, we are willing to pay the incurred cost's just tell us what they are??????????? (never gonna happen)... Just because the OFT says it will not look into any charge under a certain amount doesn't mean that's how much they can charge it is merely a threshold they are given or they will have to reveal there actual cost's to OFT and therefore everyone else. All we are actually saying is provide us with your actual cost's and we will pay them if your not prepared to do that then we'll have it all back!!!!!!!!!!!!!
In one way it could speed the process up for claimants as you get a part payment straight away with no hassle, accept without prejudice and carry on as normal for the rest????????

Banks wont speed up the process of them losing money even though it is inevitable hence the problems people are having. I have advised a few people to make claim for partial settlement based on actual statements they have in their posession while waiting for the rest. You must state that any settlement is accepted without prejudice and as part of a continuing claim for the full amount on receipt of the data.0 -

The Information Commissioner's Office confirmed that "hundreds" of bank customers have complained about the latest example of cavalier treatment by financial institutions.
The regulator, which polices the Data Protection Act, has warned the banks that their behaviour is being closely monitored and could result in prosecution.
I think it may be an idea to quote this excerpt in the letter you send.

I only have bank charges of £82 over the past 6 years. Some of the fees are just approx £3 for the month. Can I still claim these small fees back or or they reasonable charges anyway?
Every little bit of money helps so what should I do - do you think I have a claim to make. Any advice very much appreciated0 -

Your bank may call different charges by different names so anything you're not sure of query with the bank.

Bank: RBS
16th Feb: First letter sent claiming £2935 +£186.71 interest. (£3121.71 total)
2nd March: Letter from RBS offering £2935 settlement.
Brilliant.
Throughout the first page the bank letter received really did appear to be a rejection in basic T's & C's legalese.
I wonder if any people have read that page and just gone 'Ah well', ripped it up and thrown it away? There was no indication whatsoever until the second page that any settlement offer was being made.
It strikes me its worth their while trying even if they get a low hit rate, because the bank's default if you don't reply is to consider the matter closed with no settlement.

Capital One credit card
Claimed: £1019 (inc 8% interest & court fee)
Received: £1019
Had to take them to court. They acknowledged, sent two offers of the difference between the charges and £12. I declined the offer and pressed on with MCOL. Once MCOL filed, I sent the detailed charges to their solicitors. Received full offer letter yesterday (8 days before their defence was required) which they've already credited my card account with.0
