    I would go with that option and give them 7 days before you start the court action. Check your account incase they have paid the money in then you would say you accept the offer in part payment and without prejudice and are going to court.

    You need to read Martin's article and the Reclaim Help Thread, both linked in my signature and make sure you are claiming for the correct things. Debit interest on your statements can't be claimed and is different from the interest that can be added to your claim. Listen to the audio file in Martin's article regarding using that interest as a bargaining tool.

    Without prejudice

    HSBC Have made me an offer of £528.00 in full and final settlement without any admission of liability whatsoever. If my claim for a refund of £600 proceeded to court, HSBC believe they would successfully resist any legal challenge in relation to these fees. I think this is pure power & posturing but am prepared to accept the offer as it will wipe out my overdraft. To be honest I'm surprised, I heard that HSBC were closing accounts in retaliation. I do however feel that £25-£30 compounded every time you exceed agreed overdraft is way excessive! Does anyone know of a cheaper current account maybe Cahoot??? By the way it seems a good idea to let the threat of court action hang in the air! It took a good while for them to reply.

    Anyways thought I'd add my twopence; I apologise if I'm covering old ground, I have not had the chance to read through all posts.

  • could someone please help?

    I have today recived a letter from the court basic explaining that due to the incompentence of the bank they have decided that a court date is not neccassary and that I have won by the court not responding to any letters/court bundle or witness statements.

    My question is this:

    I now need to put on to a form which they have sent me all of my charges, e.g, bank charges, interest, and court fees. I have read somewhere that I can also charge for sending letters and administration. This sounds to me a little pushy, but if anyones knows of anyone else having done it and getting paid then I might as well get something else out of a swindling company.

    P.s many thanks to everyone who has helped me on my way to recovering something that has owing to me. I thank each and everyone of you.

    Amount Claimed: £260 + £35.92 (Interest)
    Amount Offered: £295.92

    The Story:

    The first letter was very negative. They did not agree with OFT's decision. The next letter gave me an offer of £150. I sent them a partial acceptance letter but also warned that if I go apply via MCOL any settlement will also include a refund of court fees as well.

    Bingo - letter received today to make an "exceptional" offer without prejudice for £295.92

    Amount claimed: £1475.50 + interest
    Amount paid: £1475.50

    Having had a major gripe about excessive charges and the overdrawn loop that they draw you into, I sent the first template letter on 7th Feb 2007 and received a reply (dated 14th Feb) saying it was being dealt with.

    I then received a letter dated 22nd Feb 2007 saying that £1475.50 had been refunded to my account. Smile chose to misunderstand the claim for interest saying 'As debit interest doesn't constitute a charge or fee this hasn't been refunded to your account'. As the money was in my account when I received the letter I've decided to accept the settlement, but intend to send a letter pointing out the 'misunderstanding'.

    Thanks Martin....without you I wouldn't have bothered.

    After a 5 month battle to obtain copies of statements, I finally received an offer from NatWest.

    Amount Claimed - £1300 (including £300 interest)

    Amount offered in settlement - £1000

    Very happly with this, and thank you MSE for your guidance and being a champion for consumer rights - cheers! :A

    I will incur cost of printing ink, paper, stamps, envelopes, electricity for the computer being on for time it takes to compose and print the letters not to mention the shoe leather for the walk down to the post office. I wonder what would be regarded as reasonable but it all adds up doesnt it.

    Oh oh and a charge for the proportion of my monthly internet fees for being online on this site for research purposes of course :D

  • Please can someone help me. I have kept the last six years bank statements so I know what the charges are but do I claim the whole amount i.e. £27.50 or a percentage of this?
