I just posted this in the barclaycard thread where I have been for the last day or so and thought I would repost it here too for everyone else's benefit
Those who have the problem of banks neglecting the 40 day deadline may be interested in this article today in The Independant :

An extract reads :
"On many occasions, they have also failed to provide information within the 40 days set by the legislation. It is another twist in the saga of the £7.2bn that banks are estimated to have overcharged customers, prompting a fierce campaign championed by The Independent for the money to be returned.
The Information Commissioner's Office confirmed that "hundreds" of bank customers have complained about the latest example of cavalier treatment by financial institutions.
The regulator, which polices the Data Protection Act, has warned the banks that their behaviour is being closely monitored and could result in prosecution."
and further :
""Which? would advise going straight to the Information Commissioner if your bank is not complying with the act. Don't be put off from claiming bank charges back. "

It started in Jan when i received a £39 charge for one letter. I complained to the bank and was told i will receive a answer in 14 days time , that was in Jan and I'm still waiting....
Well since that 1st complaint i stumbled onto this website and saw what to do the right way , so i sent them the 1st letter to request my 6yr charges that was in Feb ... still waiting but in March they had sent me a letter to say they are still thinking about my letter in Jan so I phoned them up and a nice lady in customer services has sent me a list of charges the very next day I asked for them.
Now i 've calculated that without interest it is £1903 in charges and £2463 with the interest so i have now just sent them a letter with a claim with interest for ALL my money.
That was on March 1st so they have 14 days to comply;) Personally i hope we go to court and they lose and they won't comply with the courts ruling and i want to be there when i send in the Bailiffs that would make my year :rotfl:
So good luck anyone who has had enough of reading that banks have made a record profit ...again and think you made that of my charges and i want it back0 -
I made a claim against hsbc for 970.00 i sent the first sample letter with my statment of charges and received a comfimation letter in about two weeks.After two more weeks the bank offered to pay me 822.00 but not taking no blame ha ha.i excepted the money and now going for halifax.thanks money saving expert.0

Today i won £1400 of a £1700 claim from the Norwich and Peterborough, i was just about to issue court paperwork.
I found them very understanding and i made sure my account wasnt closed.

When I asked for a list of my charges I received the last 6 years statements within 10 days. I then sent of my letter asking for the money back. 14 days later I got the standard "as a gesture of goodwill. without admitting responsibility etc." letter.
I have accepted the amount as I may have mis-calculated. thank you so much for your help. I am finally back on track with my finances.

I have today recieved a repy from the Nationwide to my request for them to repay all my bank charges. It only amounts to £42.00 but unusually they have sent my request back to me and asked for me to call into my local branch with some form of identification before they can forward my letter to head office. I had sent copies of my bank statements to them with my letter. Can any one tell me what they are up to ?0

-Date of 1st letter: 12th Feb (Received by Barclays 12th Feb)
-Response to 1st letter (saying that they'll respond within 4 weeks) received by me 20th Feb (dated 19th Feb)
-Date of 2nd letter (Letter prior to action): 24th Feb (Received Barclays 27th Feb)
After sending my second letter (Letter prior to action), I have just received a reply from Barclays in which they say they "refer to our letter of 19 February 2007" (i.e. their reply to my first letter), offering me £295 as a "gesture of good will" and admitting no responsibility, in respect of my total claim, £565 (£648.62 inc interest). I do not intend to accept this and am ready to go ahead with court proceedings. What I would like to know though is when to go ahead with this? Given that they have not yet formally acknowledged my second letter yet (rather, presumably as a delay tactic, they refer to their reply to my first letter), should I wait the 7 days (and is this working days?) from the date of my Letter prior to action, or would it be appropriate to go ahead with proceedings now?
I guess a second line of action would be to reply to their letter saying that I do not accept their offer and that I will be proceeding with court action as specified in my Letter prior to action, and see if they respond before this date.
Any advice?

Claiming from Nat West who have totally ignored 7 day letter - actually gave them 14 days coz they said didnt receive 1st letter and sent them copy giving them further 7 days - phoned a few times as well but not getting anywhere with them.
Can anyone tell me - if I claim in the small claims - I will claim for charges, interest and court costs. Can I also claim the 3 guaranteed delivery letters at 4.10 each and the recorded delivery at 90p? This might sound petty but if Im actually going to claim through the court, might as well try for everything I can!!!Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!
HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.
Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA0 -
