  • I posted the question yesterday - will I be allowed to represent my daughter if her case gets as far as court, because she is working abroad and might not be back in time.
    Decided to phone the MCOL helpline, and was told that I can use my details in the service details on the form, and if she cannot make any court hearing, she has to write to the court and say I will represent her.
    Thought this might be useful to someone else.
    Still don't know if I should deduct the £750 'goodwill gesture' from the total she is claiming and put the smaller amount on the claim form - which would make it different from the one I sent to Lloyds - or keep it the same but add that they have made a part payment of £750.
    Anyone else had the same situation?

    Please don't rely on this as I am certainly no expert but I would imagine that the bank would look to deduct any goodwill amounts they had paid from any court awarded amount.

    So I would think its important to press for the full amount while at the same time ensuring that you have informed the bank of your refusal to accept the "goodwill amount" as anything but a downpayment on whatever amount a court may end up awarding you.

    Received this offer (gesture of goodwill) 14 days after posting the first letter. Have another account that I am claiming £605 on from RBS also and am waiting to hear back in relation to this one.

    I've looked on the success board but there's only person who has mentioned one.

    What bank is it? As it could be a service fee for having an overdraft or a charge for going over your agreed overdraft although you say you have an aranged overdraft?

    If its a service fee you can't, if its for going over an overdraft limit you can!

  • Hi all.

    Once again I'm popping up to see my dear ole mum this weekend, but this time I’m armed with 2 letters for her to sign. I've got the envelopes ready, stamped, and cheques written for her (£20 for HSBC, 2 accounts. £10 for HSBC MasterCard, 1 account. She's already overdrawn and her writing further cheques would seem a bit daft!). I took the templates from Martin (here), adjusted them a tiny bit because I don't like starting straight out with a threat, filled in the details, printed them off and so it begins.

    Mum'll sign these, and I'll nip out and put them in the post tonight. Tomorrow (Saturday) I'll wheel her into town and get a new Current Account going at the Nationwide (her choice, for now).

    So what's the story here? Mum's 76, had 2 strokes (first one quite major, 11 years ago just under one month before retiring!) and many health problems. Life, just lately, has really gotten her down so now I trek up there almost every weekend to do what I can. A couple of weeks back I discovered some pretty horrible things (no, not my brother - I already know about him!). One is the mess she's gotten into financially, so now I've got to get to grips with this as well. At least she's perked up a bit over the last few weeks.

    But I need to rant first...

    I am absolutely DISGUSTED at the sheer bloody greed of so many companies, it makes me practically homicidal and want to go see these pathetic, miserable creeps at their offices so I can rattle their brains and generally perform very unpleasant surgery on them! No, not banks. I am totally flabbergasted at the sheer volume of 'junk mail' and ominous-looking 'official' charges; absolutely useless but terrifying insurance 'must-have' possibilities and catalogues that pour through the mail, each trying different, evil tactics to extort money from a vulnerable elderly pensioner!

    Damn! Mother was educated by the state (as it was then), spent the whole of her adult life working for the state and pouring her taxes into keeping the government afloat, and now, when she needs to be protected from scams and scaremongers like these b's, the state says 'Naff off, we've had the most we can get from you, so now you're left to the sharks.' Oh, hang on; they're still taxing her pension.

    Do I sound mad? I should do - it's getting harder to stay focused when facing such a deluge of greed. It is unbelievable how some people can be so foul. They deserve our utter contempt. Am I feeling guilty here? Of course, who could ever do enough to be able not to say ‘I wish I could have done more…’ when the time cometh.

    End of rant

    Okay, trying now to re-balance myself, this is the first stage of a claim getting underway, and I'll keep posting as the saga develops, each step of the way. If anyone wants to throw in a 'hi' here and there, I'll do my best to reciprocate! Please forgive me if it's not a fast response, though - there are just not enough hours in the day, or night. It'll be nice to know I'm not alone, although that's how I feel right now. Mum hasn't got the strength either physically or mentally to do this, and I've absolutely no idea how much and how many (or if any?!?) charges are going to be claimed, so I guess we'll discover soon, eh?

    The story:
    After taking heart from all the other successes on this website, i decided to have a go and claim my charges back. I did the sending away for all the charges for five years (Scotland) and got a copy of every bank statement for that time. I then calculated the charges they owed me which was £2169. As per the proceedure you laid out I sent the first template letter away. The RBS didn't reply within the two week time period as per the template letter, but i came home today (three weeks after the first letter) and discovered a letter from the bank. It said that they have investigated my complaint and said that the charges were legal and fair blah, blah, blah. They did offer me, as a goodwill gesture £2169(Co-incidence as to the amount i was claiming). In summary ABSOLUTELY DELIGHTED!!!! This would never have happened if this site wasn't about. The times when the bank left us with no money in our account after taking these charges and as a result accruing more charges was a financially an emotional time for us but this small act of revenge for the consumer has given us a big lift.
    I would finally point out that I think the banks are now fearing these 'Template' letters from this site and submitting earlier. If you haven't done it yet get they charges off your bank now!!!!!

    It was for Natwest and Barclays. I have an arranged overdraft which I always go into and used to be charged a small fee. This no-longer happens. It does sound like this is something I cannot claim for by what you are saying. I thought I should check, thanks

    Use the same letter just change the wording to read you are claiming for late payment charges and/or over limit fees.

    Check with the NatWest account then thats its not been a Gold/Blue or whatever advantage account.
