    Hi,

    I was just wanting to know whether i have to send off for all my statements for the last 6 years. I haven't even had an a ccount for that long. I have in my possession statements for the 07, 06, and tail end 03, begging of 04 years, so have not got my 05 year statements for some reason.

    I am not massivley interested in claiming charges for the 05 years and just want to go straight into reclaiming for the years where i do know what i have been charged, which is only a little amount(under £300).

    Is this ok, or do i still have to send off and wait a month for all my previous statements?

    im on letter 6 now as barclays havent responded to the claim via our joint account they are delaying on my own account as i have two claims going with them

    what i want to do is the without predjudice letter but what i want them to do is settle our two loans and our overdraft instead of money as they work out roughly the same amount of money please note i am repaying barclays 2.00 per mth on each account as my partner lost his job

    i have had a reduced settlement figure of roughly the same amount of money as we are claiming

    can i do this and how do i word the last part of the letter (without predjudice)

    It sounds to me like a tactic that insurance companies use. If you accept any money before the court date then they can argue that you have settled out of court. I would post the cheque back to them, recorded delivery so you can prove it.

    Hi Everyone,

    I'm new to this forum but started claiming charges back after seeing Martins programme on the tv. I claimed back all my charges from RBS, cheers MSE, and recently set about getting my money back from Barclaycard.

    I just received a reply from them today and they have said they will pay me the difference between the amount I have paid and some recommendation in a report that said it should be £12.00.

    Can they do this, I didn't think the ruling was until April? :confused:

    STORY: I simply followed Martins advice, wrote out the template letter adding my own details,(i`m not very good at composing formal letters)and lucky for me i had all my statements . I received a letter back shortly after saying my letter had been forwarded to another dept. I expected to either have to chase it up wth another letter, but ... NO!! I received a letter this morning to say i was getting my money back !!!! EASY ! GIVE IT A GO .., you have nothing to lose . A HUGE "Thank you" Martin.

    This is what I found on the OFT web site:

    "...5. Whilst the principles applicable to credit card default charges are applicable to bank account default charges, the threshold figure of £12 is not. The OFT will not consider whether a further detailed investigation of the fairness or level of individual bank default charges is needed, or what solution might be required, until the end of this fact finding exercise...."     So it means 6 months ago they found it unfair to charge even £12 on current accounts. I really hope the'll stick to that in April. Until then I don't think the bank has the right to use that as a threshold.

    1st letter sent - lloyds refused
    2nd letter sent - lloyds offered full amount
    475.00 paid direct into my account and they didnt even threaten to close it although i already have! hahahahahaha

    Keep up peeps and get your charges back as it's not as difficult as you think, and a BIG THANKYOU TO MARTIN LEWIS OUR HERO!!!!
