    But of course, that only applies to bank accounts. On credit cards,unfortunately,the £12 charge is accepted by the OFT.

    - Letter Before Action sent 5 Jan 2007 :dance:
    Claim filed 15 Feb
    Defence entered 26 Feb

    I am claiming from Capital One for 2 credit cards I have with them, 1 open and 1 closed.

    They offered me a refund of the difference between the charges and the £12 they have now reduced it to but at the time, people were saying they still refused this and took their claim on.

    I did the same and have my claim with MCOL now but I am now starting to worry because on a few threads I have been reading, people are now starting to say that on credit cards the £12 charge is now accepted by the OFT so we have to accept this offer :huh:

    Is this true and if so what do I do now? Can I now contact them and say ok I accept the offer I turned you down for a couple of weeks ago :confused:
  • Barclaycard claim has gone to count and a date has been arranged for the 4th April!
    After my Lloyds success, i am confident they will settle!!

    The £12 is recommended by OFT, not accepted and nor does it mean you can't take it further and ask the court to decide.

    I have an account with Alliance and Leicester, I have only had this account since July 2003 so can only claim back that far. I also had an account with Barclays until January 2005, how far can I claim back on this account? Six years from now or the last six years of the account?

    Hiya just read the press relase and it states

    'In April, the OFT stated that credit card default charges had been generally set at a significantly higher level than was considered fair and set a £12 threshold for OFT intervention unless there were exceptional business factors.'


    This as stated above is merely the threshold set by OFT, that if the charges go over then they will intervene, it does not state that this is what the credit card companies should charge, they are charging the most they can without being checked on by OFT, it does not mean this is how much it costs them to print it on your statement, and lets face it that usually all they do...

    Open to correction if got this wrong...
