Please can someone help before i tear my hair out? I sent off my letter requesting statements yesterday because I could only acces 5 years staements online. Turns out as I'm in Scotland I can only claim 5 years. AAAAAArgh. How could I miss that??? Can't understand the scottish thing. can't find my way around this board and can't log in to CAG.
can someone please explain in really easy to understand language for thick people like me what i have to do re claiming £6000 from LLoyds TSB in Scotland?0 -
Right. Here goes claim number 2. It was about a year ago i claimed charges back from Halifax. Before moving to the Halifax i was with Abbey and racked up a few charges there. I closed my account when I opened my Halifax. I've heard on the news that the OFT are looking at bank charges as a whole and may set a limit on what they can charge. Anywho, some people are saying that if the a court rules that a limit of say £12 is acceptable for a charge then banks will only give you back the difference. IE charged £39, court ruling £12 Difference £27. So this has made me get off my backside and into action...again. I posted on here saying how I managed to claim back my last bank charges and was quoted on the front page of Martins email (grasping a straws for a claim to fame here!!!) so I'll keep you all up to date on my progress as I see there are always new people joining and asking how it works.

I am in the process of reclaiming charges of £1100 from Abbey for the past 6 years. They have written to me saying that they are sorry i have complained & that they need to investigate my claim & that it will take upto 4 wks to do this. The 4 wks are nearly up & i have not heard from them. Should i wait or are they mearly stalling, hoping to delay their decision until April when banks will probably reduce their charges to £12.
Do i write again & tell them to pay up or do i take them to court?
Has anyone else been in this situation? How did you deal with it?

Send the letter before action and if they don't reply within the 7 days you need to start court action.0

Background:
I have a DD instruction on my Abbey credit card to pay off the full amount every month. Because I get paid in the middle of the month, I sometimes want to pay off my balance before the DD payment kicks in lest I fritter away my cash in the intervening 3 weeks. This has never been a problem before, but on the 12th of February I paid off a substantial balance on my card (due to a work trip and Jan sales, etc) and left it with about £13 to pay off. Last night after noticing a big gap in my current account I realised that on the 28th Abbey took about £333 out of my account and the card is now £320 in credit! I called them last night and they said the cash left my account because the payment instruction goes in loooooong before the money actually leaves my account, but surely they should realise what state my credit card account is in within 16 days? Anyhow, I was told that they would pay the cash back, but that I'd have to wait until next Tuesday/Wednesday to get it.
So my question is:
With all the press about banks doling out unfair penalty charges to people who have gone 10p overdrawn on their accounts, can I impose a penalty charge on Abbey credit card for taking £320 from me? Essentially going £320 overdrawn with the "Bank of ME"!! Does anyone have letter from Abbey claiming penalty charges that I might be able to change about to turn the tables on them?

Received a letter yesterday. The letter was pretty standard, they ignored (with no mention of) the interest and disputed one charge of £40 so offered me the £495.
I have accepted, I suppose I could have taken the matter further but with no mention of them wanting to close my account i have decided the £495 is acceptable.
Thanks MSE I used the letter template which was all very easy. Was tempted by these companies who say they can claim for you - with MSE there is no need! :T
Am still waiting to hear back for two claims to MBNA they have said they will take up to one month to respond. Fingers crossed!£2014 in 2014£3,155.66 £20140
