    can anyone offer me some advice if a bank has made an offer to pay what they owe to you , after you have threatened to go to court and ask for the full amount plus interest charges can you still claim for the interest, or just take the amount offered ?

  • I have got a letter this morning(28 Feb) from Natwest offering me £135 i have accepted and it looks like thay are not closing my account as they said it was to be transferred to my account.

    You are not entitled to the interest until you have actually filed the court claim. If you've not done this, you must accept their offer of full settlement.

    Hi armanni,

    As i understand it from this thread, you have no right to the interest and the banks are not under any obligation to pay the interest unless it actually goes as far as the court process, if you have been offered the full amount without starting the court process then I think as Martin states the court's could take a dim view of you not accepting it.....

    But as always your choice...

    Have received a letter from Natwest this morning offering the full amount £1005. I initially started doing this for SIL and friend and neither of them have theirs back yet:confused: ...anyway it was a closed account and a few charges were just outside the 6 year deadline but they have still offered to pay.

    I called Natwest this morning to ask about getting a cheque instead as the account was closed in Dec 2001...and they said normally if the account is still open they will pay into that but if I can prove this is closed then I can request a cheque. On my last statment they sent me..it stated Account closed...so she said to send a copy of that in with a request for a cheque along with the signed letter I had to sign.

    Im very happy and it didnt go to court! I got the full amount offered.

    Amount Awarded: £2463

    Received letter today. Well Happy with this.Think the difference of £623 we had claimed in error as it was monthly account charge.
    It is to be paid into our accounts.

    Also if anyone elses claim is with Natwest the letter is really long and the offer is on the 2nd page!!!:T

    hi all

    my claim is with the abbey.
    the amount in my first letter was £5587 with intrest another £1289.78
    what would the pitfalls be with my claim above £5000 and should i reduce the amount? and how would i go about it in my second letter while saving face

    any advice would be helpfull.

    Sent my first letter on 1/2, and heard nothing back until today 28/2 with an offer of £1065.00, WOW.
    I consider us to be one of the lucky ones, however I did put a covering letter with the standard letter, explaining that we will use this money to clear our overdraft and are having a debt clearing few years etc !! :money:
    The letter back from Natwest did make me nervous, as the 1st page was all about the fact they think their charges were fair etc, and then the offer was on the 2nd page 'as a gesture of goodwill'
    Well worth the effort, and overdraft cleared. :D

    What happened was this... I claimed back £773 back in December. It was due to be paid back to me in early February but then it never showed up. I repeatedly phoned them and asked when it would be in and they always said that night but then it never appeared. I ended up getting charged for a failed DD because they hadn't paid my money back within our agreed time frame. I was fuming and couldn't be bothered to talk to HSBC anymore and so I called the ombudsman to complain about HSBC being incompetant. The ombudsman wrote to HSBC and sent a copy to me but the way the complaint was worded was a little confusing. I decided to wait for HSBC to contact me as I had wasted enough money yelling at them... Got a letter from HSBC this morning thanking me for asking for charges back but asking for more info on the charges. I got straight on the phone to the complaints dept. and said I had not claimed back any more charges and what had they got wrong this time. The woman tried to find out but drew a blank so I explained everything that had happened. She said the behaviour of HSBC was a mix of confusing and disgusting and immediately refunded the £25 I had been charged. My complaint to the ombudsman had not been about the money; it was to just let them know what HSBC were doing to me and make sure it didn't happen to anyone else. I can cope without an apology cos £25 is more than satisfying :D
