  • I must admit to being a bit cynical and thinking yeah right........ like this ever going to happen, but 6 weeks after printing the first letter off, I have recieved a credit to my account for £835. I am delighted and just want to say, I love Martin!!

I have sent away the first template letter requesting my charges for the last five years, (Scottish Law), i have received details of all my banking details from February 2001 til February 2004!!!
I have written to the bank requesting that my original request be fulfilled, ie the last FIVE YEARS, statements. I have also instructed them to return my request at their earliest opportunity.
I have informed them that as my original request was not fulfiled then i should not be entitled to pay another £10 admin fee for the information.

Have i done the right thing?
Is this a stalling tactic by the bank?

The banks sometimes send the statements out in batches. They have 40 days to provide this information and if it isn't done within this timescale you can then complain.
  • Thanks for help. I am extremely grateful - and looking forward to taking the people to task who caused such upheaval in our household over indiscrimate charging (£175 for 3 uses of the bank card which totalled £15).

I received the Note of Issue in the post just now - Northampton. In a way I hope we go to court and I will take a camera if it proceeds!
  • We posted my husband's request for back statements on 5th January - he heard nothing so went into Barclays who said they had received nothing. I posted mine the same day, got them a couple of weeks later, and am already at the stage of threatening court action due to non-response by them to my claim. However, yesterday my hubby's letter arrived back from Royal Mail, along with the £10, saying that the address was not known in this area!! The address was 100% correct, including the post code. So we are now almost 2 months down the line and the bank, quite rightly, have another 40 days to supply the information; Naturally I am going to complain at the highest possible level to the RM.
However, my hubby has heard that there is to be a hearing at the OFT/Trading Standards on 14th March to discuss all of these claims. Is this true? If so, will any change to policy affect those people who are already in the system for claiming their charges back?

    Thanks in anticipation.
  • HELP

I am up to stage 4 for reclaiming and I am a bit confussed with the sample letter.

When you have to put in the name of the court I don't know what to put

    Please can someone help.

    Thanks

  • The name of your local court or just say local court.

Must admit, I was wondering that myself as i've sent the letter asking for my statement of charges on Feb 9th and heard nothing yet. Wondering if the banks are now going to start stalling pending the outcome of this hearing. Thats if there is actually a hearing, it's just a rumour i've heard so far.
  • Hi, Im new so i hope im doing this right??

Ive taken Martins advice and followed the procedure to reclaim bank charges.

I have 3 accounts with Natwest, Current, savings and a personal loan (£8,000 approx) to cut a long story short, last xmas I became overdrawn, Natwest called me and advised me to take a new loan to cover the current loan i had and my overdraft, as they had charged me £115 for every POS fee I had no choice but to take the loan. The new loan was 50% more a month and having lost my job i struggled to make the payment. By june they closed the accounts and despite me offering to pay they passed everything to a debt recovery company whom im now dealing with.

I had a letter from Natwest offering me the full amount refunded back to me (£1719,00) but in the letter they said that the amount would be paid directly into my current account, this being closed i called Cus Ser. They advised that the amount would be taken off the total outstanding amount and would just reduce the debt owed.

However, i know i should be happy with this result but i would really like that £1719 paid to me! i have 2 small children and the cash would be really handy and i am happily paying the debt recovery company a fixed amount a month.

    Any advice.

Sorry this is a bit long winded but id be mega gratefull if someone out there could help.

If you're referring to the OFT investigation, don't be concerned about this. It shouldn't affect your claim directly.
  • Hi, I'm in the process of reclaiming £1400 from Lloyds TSB. I wrote to them about four weeks ago saying I would accept £1000, and as in Martins advice I gave them 14 days to cough up. I hadnt recieved a reply after three weeks so I submitted my online claim for the full amount last Friday. Today I recieved a letter from Lloyds TSB offering me £750, and that the money will be credited to my account over the next few days. Obviously I am not accepting this offer, but should I write back to them or will they just assume I am not accepting it as my claim has been issued?
