    i claimed back £1333 5 weeks ago from my current account got it no problem rememberd i had a saving account that had some charges 2 years ago emaild them forgot all about it looked @ the account online full amount i asked for had been paid in today.......

    Had £10 cheque returned so no charge for statements. Mum refused £1000 offer at first and offered to settle for higher but less than full amount. They refused and reoffered £1000 which she decided to accept. She wasn't confident about taking court action even though I tried to assure her it was better to make a claim. Her decision in the end! Better than nowt! :beer:

    The Story: Sent first letter off claiming back charges 6th Feb, heard nothing so sent 2nd letter saying that i would take it to court if I did not hear from the 22nd Feb and the next day I recieved a written offer of £2,412. Theconditions are - "Any charges that properly accrue in the future will be applied to your account in line with our published tarrif....should you be unwilling to accept any such charges, then we may need to consider if we are prepared to continue to provide you with your existing banking facilities. Instead we can offer you a simple account that does not offer borrowing facilities or other services that can result in charges". Shall I accept this offer but not their terms? Does anyone have a template letter I can send that says this in a more legal matter?

    I am happy with the offer though as it was very easy to do and I would encourage everyone to claim back their charges.

    Have had a goodwill offer from Halifax however don't consider it to be enough - so have used template from this site to do second letter asking for a higher offer or I will take them to court. What do I put as the name of the court in the letter? Is this my local county court - or just county court? Would appreciate the advice.

    If you choose to use Money Claim Online (MCOL) Then it is automatically Northampton Conty Court. Regardless of where you live.

    My Story:

    Basically I wrote my first letter to them requesting the charges back, and they did the usual and refused. I left it for a while because I couldn't afford to take them to court. My mum came home one day, and said that the Financial Ombudsman could help (for free! - Very MSE). I printed off a complaint form, and attached all letters etc, heard back from them a couple of weeks later saying I should hear from the bank in a few weeks. Got my letter today offering the full amount, which should be in my account in a few days :T

    Hello,

    Just wanted to share and say a big thank you to Martin, today i recieved a letter from HSBC who have agreed to pay my suggested settlement fingure for the bank charges i have paid over the past 6 years!! i so happy!!!!!!!!
    I have pais 1860.50 in bank charges and they have agreed to pay me 1589 as a final settlement, what a result,

    This is well needed as i am currently on maternity leave and finding money and budgeting hard and was not able to afford the 120 to take the bank to court

    The bank agreed settlement on my second letter!!!
    Any who hasnt tried this yet should give it a go, i NEVER thought it would work and now in 1500 better off!!!!!!

    Just to make it absolutely clear, in my letter i just said i would be taking them to court useing MCOL didnt mention the name of any county simply MCOL.
  • You don't mention MoneyyClaim at this stage you just put in the name of your local court. If you do your claim through MCOL the claim will start at Northampton as this is the nearest court to MCOL and then if the bank put in a defense the case will be moved to your local court.

    In fact you can leave this bit out of the letter altogether and just say you will be taking them to court.

    Very easy! Asked for my 6 year statements, I calculated, used template to claim and after 14 days paid into my account. I am so so happy I have been living in my overdraft which seems like forever, now I am finally in credit!!! Thankyou so much Martin!:rotfl:
