Hi All,
I am currently 1 week into the 28 day period where Halifax have to defend. Yesterday i received a piece of junk mail from a debt handling company offering to consolidate all my debts. Seeing as i am fortunate to not have many debts i was wondering if this was another dirty tactic by the banks? Has anyone else experienced these agencies contacting you after starting proceedings with MCOL?0 -

Have been watching all this avidly in the news and have now decided to take the plunge.
I had an account with Cahoot for sometime until I was off sick for 5 months end of 04 start of 05. I hadn't been in my job for long so wasn't entitled to much sick pay and despite trying to negotiate reduced payments etc with cahoot like I did with all my other creditors they refused to play ball, spent months and months adding default charges/overdrawn charges and everything else you can name onto my current account, loans and credit cards that i held with them. They then passed the debt onto a debt collection agency that immediately agreed to the same offer i had originally made to cahoot.
Can I still make a claim for these charges? Does anyone have any experience of Cahoot or similar circumstance? Should I treat all accounts as separate or should I lump them altogether in the same claim?
Any feedback gratefully recieved as I have to admit I am still slightly nervous about getting involved with Cahoot again and would like to be forewarned of any potential probs.
Thanks in anticipation.
You can put in a claim but as this has been passed to dca its likely that any monies reclaimed would be put towards this debt. Have all the debts from your different accounts been put into one? If they have and you make a claim then just lump the claims together, if however they are separate "debts" then make the claims separate as any monies reclaimed would be put into the individual accounts.0 -
Bank: HSBC
Amount Charged:£400
Amount Received: £452
I actually received my cheque in the post this morning!! Which is Fab because I go on holiday on Thursday
Took a long time to get my charges back - HSBC used a lot of delaying tactics and were a total pain in the backside!
I didnt think I was going to get it for a while because they sent me a letter on Saturday saying they were going to pay it into my account - and I replied straight away saying that I had closed the account
But thankfully it is all over now!!

Just received "Notice that Acknowledgment of Service has been filed" from MCOL. Its all self explanatery i think. On the response pack Barclays had three choices to tick, and they intend to defend all of the claim. Is this what most people are experiencing? I have claimed a total of £2620, £550 of it being interest.
Many Thanks.0 -

Yes. I am claiming for 2 banks at the moment and have received the same from both. Think they just do this to get the extra 28 days :rolleyes:0 -
Bank: Alliance and leicester
Amount Reclaimed: £109 plus £30 court cost
Amount they paid:£139
The story: Sent first letter mid January and had to go as far as issuing claim through moneyclaim.gov.uk but they settled within 2 weeks. Letter with cheque says "As is clear that you do not acceopt terms and conditions for operation of the account we will shortly be contacting you to discuss its future operation". So will be interesting to hear what they say!
Thanks Martin .0 -

Hi there,
Have had a goodwill offer from Halifax however don't consider it to be enough - so have used template from this site to do second letter asking for a higher offer or I will take them to court. What do I put as the name of the court in the letter? Is this my local county court - or just county court? Would appreciate the advice.
Thanks0
