I do apologise for asking this as it probably has been asked plenty of times in 131 pages.... Can you claim for going overdrawn or is it just charges like letters etc? The other thing is that I want to claim from banks and credit cards from years ago, but don't know account numbers etc, will this be a problem?0

You can claim if you are charged for going overdrawn, also you can claim overdraft interest but only the part that is a direct result of a charge putting you over your overdraft. Send the SAR with as much information as you can they will still have your details.the way forward is the consumer action group .co.uk0 -
Thanks for that...0

Please read post 4 in the Reclaim Help Thread in my signature for what you can claim and can't.0 -

No response yet as of 26th February 2007 which is one calendar month. Should I send it now or have they got a certain amount of time they can wait til they respond.
Thank you.

Send it now as you have given them long enough.0 -
Lisa137 wrote:Hello there - I am new to this site - have found it extremely informative but have a question that I don't seem to be able to find the answer to anywhere else! I am going to try reclaiming my bank charges from Abbey. However, I am currently in a Debt Management Plan and one of my creditors is Abbey (my overdraft). Does anyone know, if I am successful in claiming my bank charges back, whether they will reduce my debt owed to them or whether I will receive a cheque? Obviously I would prefer a cheque but, quite frankly, even a reduction in the debt I owe to them would be good. I wasn't sure whether the bank charge repayments are dealt with from a separate office, whether it will show up on their system etc. Any information/experience anyone may have about this would be gratefully received.
Thank you.
They are likely to credit the "debt" with any monies reclaimed which as you say will reduce your debt to them.0 -
You can of course always ask for a cheque. however repaying the debt would be my advice.the way forward is the consumer action group .co.uk0

Please read this regarding Claiming in Scotland.
As regards the rest of your info/statements, its not a case of going "straight to court" with any claim. You need to work out your total claim and then follow the steps in Martin's article, link in my signature.0 -

I have done the spreadsheet but i want to know if i should just do the date and the amount charge or the date, what the charge was for and the amount.
