    The story:
    For my Dad - Received statements from them within 7 days (£5 charge) and totalled up charges and sent letter claiming them with interest. Received a letter after 2 days with reference saying they would get back to me. Received phone call after 2 weeks offering me £950 - I bit their hands off. Thank you for your help with this. Now I am going to tackle Natwest (my own account) for £2695. Letter sent today so fingers crossed.

  • Hello there - I am new to this site - have found it extremely informative but have a question that I don't seem to be able to find the answer to anywhere else! I am going to try reclaiming my bank charges from Abbey. However, I am currently in a Debt Management Plan and one of my creditors is Abbey (my overdraft). Does anyone know, if I am successful in claiming my bank charges back, whether they will reduce my debt owed to them or whether I will receive a cheque? Obviously I would prefer a cheque but, quite frankly, even a reduction in the debt I owe to them would be good. I wasn't sure whether the bank charge repayments are dealt with from a separate office, whether it will show up on their system etc. Any information/experience anyone may have about this would be gratefully received.

    Thanks So Much For Setting Up the Process in Easy Steps.

    I have sent my letter to the bank on 16th January 2007 requesting refund of charges applied to my account, along with a list of the charges. On 25th January 2007 I received a letter from my bank stating that "we are currently considering your claim and will respond to you as soon as possible". I have in readiness typed Letter 4 to send to them.

    My question is how long should I wait before sending letter 4 (the one where I tell them if I don't have a reply in 7 days I will start court proceedings). No response yet as of 26th February 2007 which is one calendar month. Should I send it now or have they got a certain amount of time they can wait til they respond.

    Amount reclaimed £539 I offered them a settlement of £450 but they decided to pay up in full, never thought it would work but thanks Martin, i'll try and invest it wisely.
  • Not sure if my story really counts - I claimed all my charges back at the time the charge was applied.

    First time: I'd asked my bank for a £100 "buffer" overdraft, which was refused. I made a payment on my debit card, and within a week recieved a letter saying I had exceeded my account limit by mere pence. I rang the bank and put it to them that they could have refused to allow the payment to go through if there were not sufficient funds in my account. They said that wasn't possible with the type of card I had, and OFFERED ME AN OVERDRAFT!!! I pointed out that my application for an overdraft had previously been refused, though I had provided a detailed, honest and accurate budget (and had no other debts at that point). They agreed to refund the charge.

    Second time: The same bank still had not given me the £100 buffer, and due to a cheque clearing later than expected, I exceeded my account limit. When I was once again offered an overdraft, I reiterated that my previous application had been denied. I also suggested that, if I did not have the funds to make a payment of less than five pounds, what on Earth made them think I could then afford to pay their £25 charge? Once again, the charge was refunded. I closed my account at the earliest opportunity.

    Third time: My new bank gave me an interest free overdraft automatically. My contract of employment stated that my salary would be payed into my account at 12:01AM on the last Wednesday of the month. On payday afternoon, I went to the supermarket and spent a fiver or so on food, and bought some things in town - less than £25 in total. A few days later, I received a letter telling me I had exceeded my overdraft limit. When I rang the bank they said it was because I had spent about £25 before my salary was paid in... but my salary was paid in over 14 hours earlier?? I explained the BOMDAS rule to the person on the end of the line, which shows that addition must take place before subtraction, and also reminded them of how to tell time. I was quite patronising, I admit, and it wasn't the poor call centre workers fault! BUT, it worked, charge (£35) refunded.

    Fourth time: Same bank, I was struggling to manage on benefits and a direct debit was returned. Some money I'd been expecting to go into my account hadn't and my meagre dole money couldn't cover it. I rang the bank. They asked me if I'd ever had a bank charge refunded before. I thought they ought to know that, seeing as they were my bank, so said no. The charge was refunded, but the agent said it would not be done again.

    Fifth time: I was keeping careful track of every penny I spent, be it direct debit, standing order, cheque, even cash. I received a letter from the bank telling me I had exceeded my overdraft limit. I rang in a panic, assuming my identity must have been stolen as I had been keeping such a close eye on my money. It turned out that by misreading a letter from an insurance company, I had agreed to keep their policy and they had taken their payment. After a fraught half-an-hour going through every single one of my transactions, the agent agreed to refund the charge as I "usually kept my account in good order", even though I never paid in enough to generate a balance higher than zero.

    Sixth time: it hasn't happened yet. But if it does, I am prepared. A friend of mine was charged £50 by her bank (this was nearly 10 years ago) for being less than 10p over her limit. She paid the charge because she was scared to challenge the bank over it. She now regrets it, because it's too long ago for her to claim it, and the many other charges she incurred whilst at uni, back.

    Good luck to those fighting the banks for money that is rightfully theirs.

  • I claimed back £2155 from the halifax minus interest they offered £1528 after a call to them they offered £1850, better but i thought i would push my luck....
    called them back and said if you call it £2000 i wont take it to the court stage

    according to them money will be in my account within 14 days. heres hoping
