When you open up a current account you normally have to credit a minimum amount into the account each month - OK fair enough.
However, if you open a new account and your existing banker does not 'send you packing' how do you deal with the parachute account that you've now opened.0 -

OK, if you're after specific legal advice you need to go to the Citizens Advice Bureau or a solicitor. The advice on here is general advice regarding bank charges.RBS's solictors have said that they would like the following information:

They're asking for a list of charges, have you provided this with your letters?1.2 In relation to each charge, please clarify the following a) is it the case of the Claimant the samne should not have been charged? b) if yes: please explain why the claimant contends that the same should not have been charged c) If no, is it the case of the Claimant that the same should not have been charged in this amount? d) If yes, please explain why the claimant contendes that the same should not have been charged in this amount and dientigy the sum the claimant contends should have been charged. e) if not, please state the claimant's case.
You are not saying you should not have been charged, but are contesting that the charge should be proportionate to the cost. If you used the particulars of claim from here, this is clearly stated to the bank including the legal points you are relying on.2. In your claim you state that the charges are: "unenforceable under the Unfair Terms ....... Services Act 1982".
3. Please specify all of the facts relied on by the Claimant in support of the contentions in paragraph 3 above, and in particular please identify a0 the sections of the Unfair Contract Terms Act 1977 ("UCTA 1977) b) the regulations of the Unfair Contract Terms in Consumer Regulations 1999 ("the Regulations) and c) the principles of common law relied upon by the claimany in alleging that the contractual provisions referred to are unenforceable. Please also identify the contractual provisions that the Claimant alleges are unenforceable by reference to UCTA/the Regulations.
Again, this should be in the particulars of claim, it might be an idea if you posted what you wrote in the claim, just to confirm you didn't miss anything.0 -
I changed banks a little over a year ago due to the high bank charges occasionally incurred. I still have the statements for quite a few years back. Can i attempt to reclaim charges even though i no longer have an account with the bank?0

As long as the POC are complete and you have given them a schedule of charges then you do not have to provide any further information to their solicitors. CPR part 18 does not apply in the small claims court. And the CAB do not provide legal information.the way forward is the consumer action group .co.uk0 -
MANY MANY thanks nickmack and feedering. My POC statement was this:
1. The Claimant has an account 00652109
with the Defendant, opened Sept 1999 2.
Since 02/01/2001 the Defendant debited
charges and interest in respect of
purported breaches of contract. 3.
Defendant is aware of all details as a list
of charges has already been supplied.
Another copy will be sent. 4. Claimant
contends: (a) The charges exceed the
Defendant's losses caused by the breaches;
(b) The Term permitting the Defendant to
levy such charges is unenforceable under
the Unfair Terms in Consumer Contracts
Regulations 1999, Unfair Contract Terms Act
1977 and at Common Law. 5. Claimant claims:
(a) return of the amounts debited of £3339;
(b) Interest per S.69 County Courts Act
1984 of 8% - £950.17 continuing at 8% until
judgment or settlement at a daily rate of
£0.73; 6. Alternatively, if the charges are
a fee for a service, then they must be
reasonable under S.15 of the Supply of
Goods and Services Act 1982. 7. Costs
allowed by the Court
so, the noly thing I really need to send the bank are a list of charges I'm claiming for?
