well hi all this is my first post, i`ve been looking on the forums for a few days now and all i can say is wow what a great service your providing.
i have recently had £356 worth of charges over the last 2 days, its the banks fault and they accept that the gave me 213 back but beacause it takes 2/3 days to return it i encurred another 143 worth of charges, they wont return to me,
but from the insight from this website i went throu 2.5 years worth of statments and added up to £1246 in charges
so i rekon im up for about 4 grand back,
ALSO
i phoned my bank NATWEST and asked for my statments for the inland revenue its gonna take 10 days to post to me and for a cost of 5 pounds,
my brothe tried to do the samething but said why he needed them and its gonna take up to 40 days for his,
so the moral to to this little story is tell them its for something else,

Good tip but please be aware that the banks can and do charge for per statement so if you are using a different reason for requesting the information make sure you ask how much!0

Amount they paid: £1800
The story:
Was surpisingly easy - I know I could have argued the extra £400 but at the time I needed the money to pay off outstanding debts so I did just that!
Sent letter asking for charges to be repaid just before xmas 06, by end of January Halifax had written offering the £1800 - I called to accept and the money was in my account in 3 days! Can't honestly believe it was so easy, as Halifax have been so unhelpful about my account in the past.

Took the 2 standard letter templates, about 2 hours on the PC with Excel, £2 in registered postage, and £120 to MCOL when they didn't move fast enough!

Hi all,
Before I found this site I saw this subject on the BBC site and I therefore used their letters. I used the letter with which I stated that I had 12 months statements and therefore estimated back 6 years.
I have had 2 responses back, the first stating that they would be in touch by 22Feb - 2 weeks longer than my letter gave them. The second letter came 23rd Feb - this letter states that they are awaiting information to help them resolve the matter and that they will be in touch again by 22nd March 2007. This appears to be a delaying tactic, is it?
I am not happy about this so I want to send the letter stating that I will be taking them to court. The template letter on this great site states:
'This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the [INSERT NAME OF COURT] court will rule in my favour.'
What do I put in the name of court part? I live in Birmingham?
I have also edited the letter a little again reiterating that I estimated my charges for 5 years and that I did ask for confirmation of the amount I came to.

Really need some legal advice with this one re RBS defending my claim.....
RBS's solictors have said that they would like the following information:
1. In your claim you state: "Claimant claims [the] return of the amounts debited £3339". Please provide the following particulars in support of your claim:
1.1 In relation to each charge please identify a) the date when the chage was charged b)the amount of the same and c0 the reasons given for charging of the same.
1.2 In relation to each charge, please clarify the following a) is it the case of the Claimant the samne should not have been charged? b) if yes: please explain why the claimant contends that the same should not have been charged c) If no, is it the case of the Claimant that the same should not have been charged in this amount? d) If yes, please explain why the claimant contendes that the same should not have been charged in this amount and dientigy the sum the claimant contends should have been charged. e) if not, please state the claimant's case.
2. In your claim you state that the charges are: "unenforceable under the Unfair Terms ....... Services Act 1982".
3. Please specify all of the facts relied on by the Claimant in support of the contentions in paragraph 3 above, and in particular please identify a0 the sections of the Unfair Contract Terms Act 1977 ("UCTA 1977) b) the regulations of the Unfair Contract Terms in Consumer Regulations 1999 ("the Regulations) and c) the principles of common law relied upon by the claimany in alleging that the contractual provisions referred to are unenforceable. Please also identify the contractual provisions that the Claimant alleges are unenforceable by reference to UCTA/the Regulations.
What information should I be providing to them? I know I have to outline every single charge and what it was for, but what about the other information that I have to supply?
It seems like an awful lot of information they need - I haven't come across anyone else who has had to supply this - should I be worried??
Sorry for the extremely lengthy post! Any help would be HUGELY appreciated.

Sorry but the BBC website does say if you don't have some of your statements you can estimate your charges. They also go on to say that you should ask for your statements (as recommended on MSE) should you not have many of your statements. 5 years is a lot of estimating and not what the BBC website recommends and certainly not what Martin recommends.

The name of court is your local court. However if you do take the bank to court you will be asked for a list of your charges which makes up your defence so unless you get that information back from the bank you may find yourself on a sticky wicket. The banks do check any claim and will remove any charges from a claim that are "wrong".0 -
Thanks for your response mate. I will contact my bank tomorrow and inform them I want some closure within 7 days. If I don't hear from them I will start the process over from the start, and request all statements.

I just checked your posts and realised I had said this to you before about the BBC website. It may be that you will get a result within the 7 days but starting back would be a good idea if you don't. Depending on who you bank with it might not be a bad idea to spend the £10 now and get the statements you need while you wait.0 -
Hi , just registered today although been on your site every day since January, I am trying to reclaim charges from LLoyds TSB sent my letter requesting statements over 4 weeks ago, since been told LLoyds are a nightmare to reclaim off and will fight all the way.
they have until mar 5th and then another letter will go out asking for statements again.0
