    Story
    I have come to the conclusion that it is better to ask for the money without charges as the banks are more likely to settle. This has been my experience for myself and members of my family who I have done this for with various banks. Natwest seem to settle early and Abbey are more likely to offer a partial payment first but keep going!

  • Well i have done it. I have finally sent all my leters to reclaim my bankcharges i hope LLoydsTSB dont take me to court, but if they do i will take Martins advice and fight them all the way. I am a little scared due to the fact i have a bank loan with them and if they can shut my account down then maybe they will ask for their loan to be repaid in full.

    Wish me luck and may the force be with all of you who are embarking on this journey with me also.

  • This is my first attempt at anything like this and like you dont have much luck at anything. I hope they dont close some kind of loophole B 4 i have had a chance to fight.

    The story: Wrote the initial letters back in Oct 06, filled at MCOL with the deadline, letters came back and forth with them offering partial settlement but I declined. AQ completed. Court date was set for 19th March. Received cheque yesterday for full amount. It has taken 5 months to get this far!

    The story: My daughter was getting regular charges against her account usually just before money was deposited. This put her into the red just as a direct debit was due. Charges for insufficient funds to pay DD £39.00 charge every time.

    I followed all your excellent guidelines and templates. First letter asked for details of charges or statements. The bank ripped up the statutory £10 cheque but sent the statements.

    Calculated all the charges, added interest and sent off the claim - Negative response.
    Second letter as per template, Threatening court action - Positive response, customer advisor to look into it.

    Two weeks later offer for full amount with a proviso that they reserved the right to close the account and she had to sign saying this was a final settlement on the claim.

    She has since received three more charges so she has changed her account and we are about to start the whole process again for the additional charges.

  • sent my first letter 28 dec. sent my l.b.a 14 days later offering the bank
    them to pay me 75% ( £2781 )of what i was claiming £3671. they refused to take me up on my offer, so i proceeded with m.c.o.l. on the very last day
    before i was due to claim judgement 24/2/07, i received a large letter
    containing the banks blah blah blah defence and also in that same envelope
    was an offer for the full amount £3,671. GET IN THERE MY SON!!!

    of the tunnel of debt until i read this site thoroughly.

    Its not5 a loophole, the banks actions are unlawful.
