I feel really thick asking this but, I am about to send the 2nd letter to my bank (HSBC) reclaiming £1600 of charges. I sent my first letter on 3 Feb but still haven't heard anything from them. I have now downloaded the template letter informing them that they have 7 days to settle or I will take them to court. My question is on this template letter I have to input which court I will be using. Does this mean the nearest to where I live? I am a bit confused because I also read that it can all be done online. Do I still need to name a court if I intend to do it all online? Any help would be v much appreciated.
Also, another question...Is it worth ringing my bank and asking why I haven't had a reply to my first letter?

The story. Received two letters from Natwest both offering £217. Used the templates letters and obviously refused.Waited patiently and heard nothing, but couldnt start the small claims part as lack of money. But out of the blue received a letter from Natwest offering the full amount. Anyone out there having doubts about reclaiming.Do it, if I can you can. moneysavingweb is a great help. Good Luck0 -
Hi, I'm with the Halifax and I don't have an overdraft facility so the charges I have been charged, although they are extortionate, haven't put me in in the red as far as an overdraft is concerned and so I have had no overdraft charges. What i have had is £39 per returned DD, so can I still claim or is it only Overdraft charges you can claim for. Thanks.0

Sent off 1st letter 15/02/07...got reply on 20th saying they don't accept OFT ruling but went along with it anyway but still refused to pay anything...phoned up the number on the letter and asked if this was their final decision and got told no and they will look at it again! said they'ed reply that day or the next...nothing by 23rd so phoned again...this time told they usally offer 50% so £100...said that wasn't enough and that i would only take the full amount....was told he'd have to get authorisation from his manger first but that an offer would be in the post for 'full amount' and to sign it and they'd send me a cheque as my balance is zero, otherwise it would have to come off my balance...got letter this morning (24th)...signed it sent it back....
All that from letter saying 'we've fully investigated your claim' and 'we are not prepared to make any refund of default charges or provide compensation' to getting the whole lot back!

i am typing up my bank charges (yes i have kept the last 6 years statements!)
it is obvious which are charges because they say 'unarrgd borrow fee' or 'unpaid DD' or 'Referral charge' , but my question is can we also claim for the huge interest fees that they put alongside these charges?
each time i have got a 'going over my overdraft' fee £28, they have put an interest charge with it on the same day, usually between £4-11 which is interest on the money you have gone overdrawn with.
Or are all bank interest charges legal and therefore exempt from this claiming process??

After 1 letter and 3 weeks the bank gave us our charges back, no threats of court action or anything, in fact they said they would be pleased to offer us our money back to resolve the dispute, we accepted no question! Now we take on the credit card companies!:j0 -

Just like to say, this site is so helpful, and after watching last nights program I was inspired to check out how much my bank (Lloyds) had charged me over the last few years.
Online banking with Lloyds is great as you can search your statements as far back as 2002 and by transaction type. In under 20 minutes I could see that in 5 years, I had been charged a staggering £2800 including interest!
My question is this : I understand the priciple and wisdom of opening a parachute account, and Nationwide have already approved a current account, following a small dispute with Lloyds late last year. I don't have an overdraft, but I do have a re-financed loan with approx £7000 still outstanding with Lloyds.
If I try to claim back my charges, and they close my bank account, are they likely to foreclose the loan as well? This I cannot afford!
Any advice gratefully received!
