rizla01 wrote:It struck me that according to one of the solicitors on tonights show that the banks DONT WANT TO GO TO COURT because if the courts impose regs on them then the banks would have to be controlled by the laws imposed on them. (Did I hear correctly?)
That being the case then shouldn't i claim for a £30 bank charge and ALSO £1000 compo for the stress and worry, this overcharge has caused me and ALSO £1000 for my time and trouble in preparing this claim and go all of the way to court if they don't cough up.
Surely the sky's the limit if they are that determined to not have to face the judiciary?
Good Point! :T:T This site is great! Thanks to Martin Lewis & everyone who participates and helps so many people! Without you all, where would we be ??:T

Great follow and information.

Halifax Credit Card:
Claimed £375
Received £375
Halifax Current Account:
Claimed £786.33
Received £780
Both times I received a letter offering me half the amount, I called the number on the letter and told them I would only accept a full refund or I would add interest and take them to court. I told them I would let them off the £6.33 on the current acc charges as "a gesture of goodwill" (to use their terminology!!!!!)
Both times they settled immediately.
Received the credit card refund today on my card, current account refund should be in my account by the end of the week.
I have just sent a letter asking for £450 back from Barclaycard. In a way hoping they refuse, as I will then add interest!
Still waiting for Egg staements to come through to see how much I can claim on that.DMP with Payplan started 01/07/11
Starting debt £28,645
Current estimated DFD 01/11/2019
But I will get it over with sooner!!0 -
Good to see all the rush of people now getting their money back, due to all the media attention etc, there are far more people doing it now since I first did in 2005. Here is the update I said was coming from me on my latest case, plus all the information about previous stuff in case people did not see it, as the more the merrier to give people the confidence to start getting their money back.
Just had a 2nd claim settled in full by Barclays, the first one was £1195 from July 2005 and this one was £1062.01, started in September 2006. In fact I got 2 offers for the 2nd claim, one from Customer Relations and one from Litigation and Disputes, due to some internal confusion I think. I was thinking of trying to accept both, but I didn't bother - would have been funny to see both paid though. Same conditions as usual and nothing about closing accounts.
I got £100 refunded by emailing in relation to a number of individual charges and I also got another £95 back from customer relations just by calling them, that £195 was incurred since I started the 2nd claim and given the offer they made in relation to the 2nd claim I could have probably avoided actually messing about with the 2nd claim, I think it always goes to voicemail so just leave a message they'll call you back, it might just have been that it was too busy everytime I called.
I'd suggest giving it a try, could save you time and effort for a few chares, by calling and advising it'll save them money if they just pay now without the need for legal proceedings. If it is a long list, send them a letter so you can include them, if they don't play ball then open a case as usual.
The one I use is 0845 300 4028. That is the Swansea office, but there are others too.
I also got about £90 back in 2005 wiped off a Smile account I had, I told them to close the account as well as I did not need it, they promptly did what I said, after I paid them the outstanding O/D amount I actually did owe them.
On to the next one now, good luck all.0 -
Started with opening my new account mid Jan, asked for my excess over draft fee's from first direct 24th Jan, had all my statments printed out by them for the last 6 years and sent back to me by recorded delivery along with the £10 cheque I had sent them, put in a claim for £2240 + interest, excepted their first offer of £1974 (as I needed the cash, quickish) which was paid into my account 23rd Feb...........perfect0

Natwest - refunded £76 not much but a start!
Hi heard about this through a work collegue. Had trouble with HSBC and decided to reclaim charges....1752 & 2100 still waiting on responses. So opened a new account with Natwest...low and behold within the first couple months the charges came in, well 2 to be precise. This was due to DD payments going out early.....
Anyway decided to be cheeky and sent them the standard letter requesting the £76 back....got a standard reply within 2 days!!!! Money now being refunded back to my account as a gesture of good will......
HSBC look out I'm coming for ya!!!!!

I need advise please.
The overdraft I have on my Lloyds TSB account is approx £7,000. They have frozen the interest and are only asking for £25 per month for the next 6 months.
If I go through the process of trying to claim back the charges on this account for the past 6 years will they then insist that I immediately pay back the overdraft?0
