  • I would like to know if the H.S.B.c can allow your £8000.00 overdraft to balloon into £21.000.00 without first contacting you, for approval, this was a business account which closed in 2005, I am currently paying them back at the rate of £10.00 a month, can I get the overall amount reduced because they went over the agreed limit, normally you are not allowed to go over the agreed limit, so why are they allowed to go over this limit to such a high amount, your help would be much appreciated.

    I sent them a letter in January and they have today sent me a letter back saying they do not agree with the basis of my complaint as they believe the charges they levy are for providing services and are not penalties or charges for default. They also said they felt their charges were fair and reasonable.

    And after saying all that they still agreed to pay back all the charges as a gesture of goodwill. Thank you RBS! Now waiting to see if they close down my account.

    The offer arrived 16 days after my original letter. This letter was about 2 pages long detailing various extra bits from the standard template on the Consumer Action Group site.

    The offer was for the full amount of charges but not the interest. This comes to around £4500 and I would have pushed for the interest as well, but my current situation means I could do with the money, and couldn't guarantee being able to pay the court fees for the claim even though I'd get it back.

    I also got £500 from MNBA, which was charges and contractual interest at 17.9%, and they paid up the full amount after the second letter.

    I still have Egg, Mint, IF, BT, Sky, GE Money and a couple of others to go.

    As the address given says they are the DP Dept any DP requests should in theory go there but if you find out different I will change the address list or at least add in another. It could be that they have set up a BC complaints dept.

    Are you using the complaint letter that Rex wrote for this letter to Lloyd? Its linked to several times. Personally I would sent the letter to both addresses that way you cover all angles![/QUOTE]

  • amount claimed was £900 including interest. Got £718 back which i'm happy with. Would like to say a huge thank you to Martin Lewis for all the info provided. Going to spend this on holiday in May. It took about 2 months to get the charges back but it was worth it. Thanks Again.

    After sending the second letter threatening court action they replied saying they would pay up (without paying interest) because it would cost them too much to defend it. I'm happy enough without the extra hassle. :rotfl:

    How slow am i? I only heard about this on Sunday & my letter was in the post on Monday morning requesting my statements.

    Just wondered if there were any other people in the process of claiming from A & L as from reading some of the posts they seem to be one of the more obstructive banks & one of the banks that seem to take it to the wire & hold out as long as they can!!

    Knowing my luck the Government will change banking policy before my claim comes to fruition!!! PLEASE GOD!!

    A & L should be ready coz i intend to take it all the way!!!

    Got a letter from MBNA with a paltry offer of £163 !!:mad:
    Rejected it immediately, have now written 2nd letter threatening court action.
    Let's see what happens next!!

    Refused after first letter, after second threatening court action they've agreed to pay the pull amount with a long long letter telling me how I should learn to manage my own finances better! Cheeky!
