    Dont you love it when a plan comes together.

    Bank: HSBC
    Amount claimed: £1,915.00
    Amount they paid: £1,604.00
    The story:- Managed to get 6 years worth of statements from the branch (rather than wait for months of excuses via the bank).

    Took everyones advice, 1st letter sent demanding payment within 14 days (sent recorded).... No reply from bank.

    2nd letter sent demanding payment within 14 days or i would see them in court. 14 days past no reply from HSBC.

    A call was made to the bank and asked why they had ignored and what was their position. I was advised they wrote to me 2 weeks ago (never recieved, as it was never done) stating they were looking into it. I advised them either they offer an amount or i issued that day, was advised an offer had been sent the day before via letter (still not received in post, as never sent really by bank). I told them if that was the case to fax a copy of the letter to the local HSBC branch and i would collect on the same day. The offer was dated the same day as the conversation "WHAT A SURPRISE".

    They offered £1,604.00 out of a claim of £1,915.00 (which i accepted).

    Just BEWARE that HSBC will lie about sending letters, always ask for proof i.e if sent fax a copy .....put them in a really position then....wink

    The story:

    Well, I was persuaded to claim back my bank charges by my fiancee. She had started to do hers against Abbey, and wanted me to write all the letters!!! Good idea to do them both together then.

    It was a bit of a chore at times to keep up with where we were with it all, and both banks dragged it out to an extent. (Abbey in fact refunded her with about £700, which she gracefully accepted, provided the balance was paid in full immediately!) Natwest go through Cobbler's Solicitors, and so we were always gonna be up against it if the stories on the CAG were to be believed. However, all the letters that came and went were stock ones, and we transferred from the Online claim service (£120) to the local court (£100), and waited for a hearing date.

    They finally came through, and for some reason hers was 3 and a half months earlier than mine! It was a great day when she called me to say that she had just received a letter with her cheque for £1900. I was a bit gutted that I was gonna have to wait a further three months, but then Cobbett's settled up two days later!!!

    It seems then then that the banks are just paying up when the hearing comes through, even if it's a long way in the distance. A complete result, as we are buying a house and now we can use the money as our deposit!

    Thankyou so very much Martin for all your guidance and support :money: :A and a message to everyone out there: Do not be intimidated! You will win!!! Even if you are the first person ever to go to court, rely on thousands of supporters to see you through it, I'm sure we would all chip in, even though they would never win!

    Edited to say: I have to just say a word to anyone thinking about taking this up - it seems as though there are alot of people either taking the banks first offer and settling at some lower amount, or not claiming for the full six years. Please, please, please listen to me people! You WILL get your full amount back!!! Don't be lazy! Work it all out and don't settle for second best - as soon as the hearing date comes through, the bank will back out as they CANNOT go to court!!! YOU HAVE THE UPPER HAND!!!!

  • You can ask for interest but you will only get this if it actually goes to court.
  • The banks will not offer interest unless/until it goes to a court claim as they are not obliged to.

    Have a read of Martin's article again and listen to the audio file within where he talks about adding in the interest when you initially claim as a bargaining tool.
  • Go for the interest you are legally entitled to it if it gets to court, which dependant on nbank and case it may well do.

    Good luck Paul, you should get that back fairly easily, but don't quote me. As the charges are iniquitous, your reclaiming cannot be held up as vexatious. If they try to call in your loans or close your account there is a case of the OFT upholding a complaint against a bank who did this. Is on another free reclaiming site. Am sure someone here knows of it and can send you the link.

    Story : Started Sept 2006 - Paid out February 2007
    Claimed back on behalf of my (adult!) kids (50:50 approx)!
    I got a real sense of satisfaction.
    My son got a helping hand in buying his 1st house.
    My daughter got to clear her debts and get ready to set off on a 1 year round the world trip debt free.

    P.S. Barclays admitted that they had a policy whereby when a Court Date was set then they would settle. In the end they were in a panic.. e:Mailing and requesting FAXed signed offer letters (also e:mailed) prior to the Court Date (which was less than a week away).

    P.P.S. The kids signed the Confidentiality Clause... but I didn't!!!!!!!!!!!
  • Please can someone advise I want to claim for charges on a current account (still using) and a credit card (since closed) with HSBC. Should I make separate claims for each account or can you make 'one claim' for the two accounts?

    Anyone know or any suggestions?

    Hi,

    Have been waiting for a court date for 2 - 3 weeks and we have just received a copy of Natwests AQ.

    Under G (other info) they have put.

    Case management directions cannot be proposed until the claimant serves a reply to the request for further information which was due on 5 Feb 2007. In light of this, the Defendant may amend its defence or apply to strike out.

    So close so far, has anyone else had this? Is there anything that I need to do? Was hoping to get some direction or atleast a date from the courts by now.
