HELP!!! Can anyone advise me what to do next? I have filed an online claim against Barclays and the 28 days was up yesterday so at about 8.45 am I logged on to Money Claim Online and filed a Judgement by Default. This went through. Today I received a letter from my local court saying Barclays filed a defence, this is dated yesterday. In the defence papers Barclays mentioned that I can only claim back six years and when I looked back at the list of charges I am claiming for there are 4 (£80 + interest) that are going back a little too far. I think when I requested the statements they must have sent me more than I asked for. Does this mean I won't win in court? What should I do next? I'm really felling down as I am worried I may have blown it by not checking the dates more thoroughly!0

Can anyone advise me whether I need to add this fee into the amount of my actual claim, or will it automatically be refunded if/when I win please?
The fee will be added automatically to your claim when you file it on MCOL and should be included in the settlement you receive from your bank.0 -

Don't do anything. The worst thing that will happen is the judge will knock off £80 from the total. This doesn't affect the rest of your claim. Next you will receive an allocation questionnaire from court. Just carry on as normal. How many surrealists does it take to change a lightbulb?

Claimed £128
received £128 (100%)
Martin, I owe you a thank you. I used your template letters to reclaim my bank charges, and it was as easy as easy could be. OK, it was only £128 in charges (if the timing had been 5 years earlier it could have been ten times that), but it was MY £128 and now I have it back from the Halifax. Bring on the Natwest for both my girlfriend's bank charges and my mortgage release fee (looking forward to the 28th Feb for that one, have already supplied them with my new address to make me the offer).
Thanks again,
Martin

Bank: Natwest
Amount Claimed: £1690.06
Amount Offered: £1690.06
Accepting: of course!
Sent: 1 letter on 31 Jan and received reply today.
Cost to me: £1.50 to send letter recorded post
Martin, thank you so much.
Natwest has just contacted me to say that, although they do not accept any responsibility or consider my claim valid, "as a gesture of goodwill" they are refunding me the entire amount I claimed, including interest which I figured out using the handy calculator on this website.

NAT WEST BANK
Amount claimed: 1,788.39
Amount paid 1,212.04
After the second letter, requesting the full amount including interest. The Bank responded within the 14 days limit, agreeing to settle as a good will gesture without the interest (£576.35). After careful consideration I agreed to accept. The letter did indicate that they would continue to apply charges in line with published tariffs, and if I did not accept future charges they would reconsider continuing to provide me with banking facilities. Instead they may provide me with a simple account that does not offer borrowing facilities.
Thankyou Martin
From a very happy customer.

Here is a something that may have been experienced by other reclaimers. I thought it really strange. Barclaycard took the entire forty days to send old statments and then once they sent them, they sent 75per cent of them by microfile. There's gotta be someone I can complain to! This is really cheeky in my view, how does a normal member of the public read microfile? Does this fall under the Information commision's remit?
Any help is really appreciated.
