Bank: Lloyds TSB (Business Account)
Reclaimed £5,000 including Loan and overdraft arrangement fees. Solicitors entered a defence and 3 days later paid money into my account without requesting me to settle out of court. Now asking me to withdraw claim, which I am refusing to do since they closed my account wef 19th Feb.
Anyone know the legal position with this??0 -
I don't quite understand why you wouldn't withdraw your claim as if you don't your case will proceed to a court date and you have already been paid?
As I understand MoneyClaim once you have the money in your account it is up to you to withdraw your claim.0 -

On the claim for you just state the amount you are claiming back plus interest. The interest amount will only be determined if the matter goes to court and you win.
the web site will automatically add the court charges onto the amount you wish to claim.
Have you thought about dropping them one final line to say that on this date you will be filing for the full amount plus interest? You could send them your interest calculation. If they are making you offers now they obviously are willing to settle.

I did make one last phone call to give them another chance, thats when they upped the offer from 1000 to 1200 but said that was it!!
I have also just realised in my excitement i have gone 3 days over the six years, bit stupid of me. Wonder if this is a problem?0 -

The story: Requested statements via web-site - received promptly. Wrote claiming back charges using template 1. Acknowledgement received within a few days. Offer of payment in full received two weeks after initial letter sent. Money paid into my bank account within 2 working days of accepting offer in writing.

I should also add that when i originally sent for my bank statements, to give Barclays their due they did return the £10 cheque.0 -

I am Just looking through my bank statements again and have realised that I have only claimed for 5 years and not 6, I Know i am a dumbhead!!!!!
Total original claim plus interest is approx £2000 addittional charges not claimed are approx £260 before interest. Barclays have made me an offer based on my original £2k claim of £900. Do i have any chance to add the extra £260 plus interest?, can i use this info when writing to refuse offer? Can i start over?? Also what is the experiance of people dealing with Barclays, do they respond to to a telephone call or a letter offering to take a reduced fee for a quick settlement

Can anybody advise me......
Filed my claim on MCOL 14/02/07
When I have checked it this morning,
It says 'Issued' 15/02/07 and there is a link to the 'judgement' page.
So, does this mean the clock is ticking and is it 14 days from 15th or do I have to wait until it says 'serviced', as I have read somewhere that the
14 days starts from when it is serviced?
Bit confused.....

The court deems it be served 5 days after sent. So it would be 20th. Unless of course the bank acknowledge the claim before this date, which means they then have 28 days from the date of acknowledgement. Hope that makes sense.:rotfl:"Penny Pinching Winch"
