Can someone help please,
I sent my 14 day letter to the bank with a full description of charges, the 14 days has now expired so i'm now going to send an LBA.
However I have called them today and they have assured me that a response letter is being "checked" before being sent out and it should be with me by the middle of next week. so should i wait for this letter to see if its an offer or continue with the LBA?

- Sent first letter on 9 Jan and rec'd all charges/fees statement within a few weeks.
- Sent 2nd letter asking for the money back (£1419) on the 29 Jan and checked our account yesterday (14 February 2007) and £1415 had been credited back into our account. I sent the third letter first thing in the morning without realising it had been paid back in threatening to go to court.
Question: We haven't rec'd a letter or any form of communication that states that they were or had paid the money back. Is this okay? I'm sure it is but surely they should put in writing that they are paying us back? And, if so should we refrain from spending it until then?

Amount Reclaimed:£775 & £730
Amount they paid:£815 & £730 (£1545 in total)
wrote to smile claiming charges from 2 accounts got a letter back a few days later saying they would look into it then just as i was about to send 2nd letter they refunded in full both accounts plus £40 for a charge they took after i wrote. full refund paid 14 days after they received 1st letter and my account and overdraft is still intact. no hassle & a great result!!!!
