    Your loan should be a different agreement from your current account and your claim shouldn't affect this.
  • Unfortunatly in 08/05 my partner had to declare herself bankrupt causing her abbey account to be closed. One of the reaons behind this was the fact that Abbey charged her so much for dd returns and o/d fees(and tax credit !!!! up but thats another story).
    Does anyone know if she can still claim these charges back as the o/d was part of the bankrupcy(abbey got 3k worth of her work shares)?

  • I wrote the standard letters and got little in way of a reply so decided to proceed in the small claims court. At first the bank stated they would defend all of the claim but since then they have decided to offer me £488 of the £515 they owe. I have decided to reject this claim as I have already paid £80 to the courts and feel that I could get more out of them. Has anyone else been in this situation and does anyone have any advice?

    Me too. I've been charged £30 twice in the past 2 years by my mortgage lender, as well - is there any point in trying to reclaim please?
  • I did a search through the mortgage threads yesterday and couldn't find anything conclusive about people reclaiming these late payment fees but its certainly worth a first letter.

    I am acting on behalf of my dad who, from reading through this, should get quite a lot of money off the thieving banks.

    Now the first charge letter he has received, from the Co-Op (Smile) is completely illegible. There are random numbers on the charge list and it seems impossible to work out exactly which are charges that can be reclaimed.

    Also, after he requested the letter, they closed his account and sold his debt to a debt collection agency. Now this is against the Banking Code, so where do we go from here with regards to that?

    Any help is very much appreciated, and I would expect I will be on here quite a lot in the future after jumping on the bandwagon!! :D
  • If you have a complaint against a bank contact the Financial Ombudsman.
