I closed my wife's and my joint account in August 2005 but the bank claim they never received my instructions. We had an overdraft limit of £3500 but the bank continued paying Direct Debits and soon the overdraft grew to £7500, unknown to us. Niow the bank are r4claiming the full £7500. Can they do this and I am liable for any more than the £3500 agreed limit?0

I claimed just over 1300 and received an offer last week for 1000 up to and including charges incurred in February which I am going to accept as I'm a bit straped for cash at the mo!! All it took was the 2 letters off this site and about 5 weeks time to receive an offer. Very pleased!!

Received a second letter from HSBC yesterday offering me 3 pound more than my first offer. Letter dated earlier than 1st offer and relates to charges up to Decmber not February. Any ideas what I should do with the second offer??

As you reckon this is a bank error I would suggest you get in touch with the Financial Ombudsman as they will also help with reclaiming bank charges if applicable.0 -
Just wondering....... do the banks also tend to refund the £10 DPA charge?Just paid off my large mortgage 5 years early and loving it.0

Q2 In Martin Lewis's example "Particulars of claim" No4 where it mentions the interest. Do i put the £525.88 interest which was worked out on the online calculator. The in No5 it says "insert total charges" plus interest ammounting to a total of "insert total charges plus interest"
I never was any good at maths but find this abit confusing. I imagine the 0.028% is left out of the equation for now as i guess the bank has to add that on at the end if they loose.

Hi There
You put in Barclays registered office and address it to 'Barclays Bank plc'. The address is somewhere on this forum and also on the bank's web site
On the claim for you just state the amount you are claiming back plus interest. The interest amount will only be determined if the matter goes to court and you win.
the web site will automatically add the court charges onto the amount you wish to claim.
Have you thought about dropping them one final line to say that on this date you will be filing for the full amount plus interest? You could send them your interest calculation. If they are making you offers now they obviously are willing to settle.0 -
Missed a direct debit mortgage payment OUT of IF current account (to Coventry who didn't charge a thing!) in February and IF said they would charge £30 in March.
Got on the phone (nicely) asked to have them consider the five year relationship; they said no - the failed amount (around £1000) was "too great" to be forgiven. (I cancelled my credit card with them on the spot.)
Wrote an email telling them that if they took the money I would not hesitate to take them to court and mentioned this site along with the Sunday press. A day later they caved (but added "...it is in our terms and conditions....").0 -

Refunded £6751.95
Took about 3 months, sent the two standard letters gor turned down Filed mcol on 24/1, A&L acknowledge intending to defend 30/1 got cheque in post yesterday.:beer:
Usual stuff like you dont accept our terms and conditions, and will be contacting you shortly to discuss your account. No admission of liability, feel there charges are fair.

Ive began the process of using the Moneyclaim website. On the front screen that views the status of your claim it says the Judgement is 'Start' But when you click on this it takes you to select Type of Judgement. One by Default or the other defend. Do i have to do something here? Could someone help me out please. ThanksClaiming against Lloyds TSB

I reclaimed my bank charges from Alliance & Leicester last June and as a result A&L decided to close my account.
At the same time I complained to the Financial Services Ombudsman which I was told at the time would be a waste of time.
But I have heard from them recently, and I have been told that in addition to the refund of my charges, the Ombudsman on my behalf will be claiming compensation from the Alliance & Leicester because of their decision to close my account after I had claimed for the unfair charges.0 -
