:j HI
JUST TO LET YOU KNOW THAT I WENT THROUGH COURT PROCEEDINGS WITH NATWEST, FOR £3900 BUT WITHIN 2 WEEKS OF THEM RECIEVING THE LETTER FROM THE COURT, THEY HAVE OFFERED ME £3199.00 SO I HAVE ACCEPTED. SO FOR ALL YOU PEOPLE OUT THERE, THAT ARE A BIT WORRIED, IF YOU HAVE TO GO THAT FAR, (AS I WAS ABSOLUTLY TERRIFIED) THEN DONT BE. JUST GO FOR IT, AS YOU WILL BE SURPRISED OF THE GREAT OUTCOME THAT FACES YOU.
AND THEY DIDNT EVEN CLOSE MY ACCOUNT, BUT I WILL BE SOON. IN THE LETTER THEY SENT ME, THEY HAVE GIVEN ME SOME NEW LEAFLETS EXPLAINING ALL THE CHARGES!!! SO I CANT RECLAIM ANY MORE IN THE NEXT 6 YEARS. NEVER MIND.
THANKS SO MUCH TO MARTIN, FOR MAKING THIS POSSIBLE.

Bank: Aliance & Leicester
Claimed: £225 + £25.39 interest + £30 court fee
Recieved: £280.39
1st letter replied with the standard "part of terms & conditions" refusal letter. 2nd letter threatening court proceedings still replied with 'sorry but no!!'. Submitted court claim online using Moneyclaim.gov.uk - before the action was deemed to be served (5 days) received a letter and cheque for the full amount from their solicitors. Not accepting liability but settling to avoid the expense of going to court!!
Advised that A&L would be contacting me regarding the account as I obviously don't accept their terms and conditions.
Off to the Halifax with my banking, £100 bonus + 6% interest.
Win-win
Thanks for the encouragement.
Now for the rest of the family!!

Bank: Abbey Plc
Amount Reclaimed: £813 + interest and court fee £80
Amount they paid: £860
The story: Started in December, sent them x4 letters then started procedings on mcol on 11 jan, they wrote to say they would be defending their claim on Wednesday, but they said in their letter they maybe prepared to negotiate and to give them a call, the guy from the Abbey gave me all the talk about gesture of goodwill and commercial losses etc, he offered half of my claim, i laughed and said errr no i am in the driving seat i want £813 plus £80 court fee. He refused so I said as a gesture of good will i would waive the interest and £33 worth of charges but that was my final offer and that would only remain on the table for 24 hours otherwise off to court we go for the full amount, he said he would call me back, i received a letter yesterday asking me to sign and date in agreement, which i did and the cheque was in my post box today. yay! now i can issue court papers on IF & HSBC....
A special Thank you to Rex_Mundi & Edinburghlass!

The Nat West finally caved in. I received a cheque this morning for the full amount .. over £2800!
I'm not allowed to disclose much else, but I will say to anyone who's nerves are shredding at the thought of going to court: DON'T BE SCARED .. DO IT!!
I really thought that I'd be "the one" that the bank was going to win against
Thanks to the patience of Rex_Mundi for his suburb guidance through questions that were driving me up the wall ( .. only 4 working days to go before the Court appearance) .. he steered me through uncharted waters
Funny thing is that the cheque's dated for the 2/2/07 and it got posted to my next door neighbour's address yesterday, as Cobbetts' had put the wrong door number on the postal address .. idiots.
I'm going to stick around and help out as best I can other members whose experiences are similar to mine
Thanks to Martin and .. well .. everyone really .. I couldn't have done this without the support that this forum has given me ..
THANKYOU!!
.. now to get on with my life and put 5 months of misery behind me
Ken.

Bank: Natwest
Amount Reclaimed: £1756
Amount they paid: £1756
Sent first letter. On the 14th day received a letter saying they think the charges are legal and pointed out that they are clearly stated in their terms and conditions, which they included with the letter.
They carried on to say that as a good will gesture they would repay all charges as long as we did not contest any more charges in the future.
Thanks to Martin and everyone involved in this website
Andy
