used the template letters back in December and got the response saying that it was lawful ect, almost gave up but read in the forum that everyone with Nationwide were getting the same response, finally took it to court on the 25th Jan using MCOL, they acknowledged on the 30th and have just today checked my account there it is!!!!

Amount claimed: £100 which was all my charges going back as far as statements allowed (2001)
Amount refunded: £100
Hooray - not a huge amount but it all counts when you're a student! Felt most victorious! Wish I had more to claim looking at all the other success stories - had no idea that they would refund into the £1000's!
Wrote initial letter using a template that threatened court action. Had a reply asking for list, not statements, of description of charge, date and amount. Once they had that I was offered a full refund but had to sign and return an agreement saying that I accepted within 10 days. They claimed they belived they would "successfully resist any legal challenge in relation to these fees...but they are mindful of the management time and irrecoverable legal costs that it may incur in relation to such a claim". The money was in my account within 7 days.
Result:

They sent the cheque a week after my first letter asking for payment!0 -
I was a naughty boy, way back in 2001 through to 2004.........two redundancies, lots of debt, lots of referred cheques, DDMs etc.......charged at £30 per item !
Read all this website, and thought - I'll have a go at that !
Wrote off asking for details of all charges to RBS..........paid me £10. Actually received copies of all statements going back the 6 year claim period, promptly.
Edited the template letter, and VERY politely, but firmly, to then say I thought charges levied excessive.....I accepted that I had had an unauthorised overdraft [often !], and therefore RBS were entitled to charge........but not at the rate they did !
It is suggested that actual cost of returning each item was £7, and therefore, pretty please, I would like the excess amount taken from me returned. I did not ask for interest at this stage, reserving the right to do so [the idea of calculating all those sums, over all those years was daunting !!] I also reserved the right to take the matter further, to the FOS, and if necessary, to the Small Claims Court.
VERY promptly, my letter acknowledged. Then five days later, their offer........all of the monies I had claimed - over £5,000 [I had been naughty !].........subject to a 'lecture' as to how they did not accept my arguments, etc, and that I must confiorm that I would abide by the terms and conditions of amy account, etc, in the future..........since I have been a very good boy for the last three years, not a problem !
So.....I suggest that logic and politeness pays..........accept that some of the charge is due to the bank, and ask for the balance nicely.0 -

The story: Got to 7 day letter - it runs out tomorrow. Initially offered £900 as a "goodwill gesture". Stuck to my guns and they have now offered £3500.0 -

Asked for the details of my charges a few months ago but never got round to trawling through 6years of statements. Finally did it over Christmas.
5th January: sent the 14 day letter
9th Jan: Response saying 'We are sorry you have reason to complain, looking into it, will respond in 10 working days blah blah blah'.
23rd Jan: Hadn't heard anything, so sent 7 day letter threatening court action.
2nd Feb: Still hadn't heard anything so started the process on Money Claim Online.
3rd Feb: Sods law, I received a letter from First Direct offering £703! They pointed out they had refunded £47 of charges in March 2003. Checked my statements and they had.
So I have basically been refunded the full wack! £703!
But what happens if Money Claim Online doesn't refund me my £80 I paid when I started the court process? Can I take them through the small claims court?0 -
Bank: Natwest
Claimed: 4550.29
Offered: 4550.29
Requested charges going back 6 years and received a copy of all our bank statements. We wrote requesting our money back and they wrote back saying they would look into it. We wrote threatening court action while offering to accept £3400. They wrote back offering the full amount as a no admission 'goodwill gesture'.
