The Halifax did not comply with showing me how their charges are calculated due to Data Protection Act!0 -

Sent letters plus charge summary to HSBC, 08.11.2006, 22.11.2006 (recorded del, still not delivered, bloody RMail), resent 04.12.2006. Track and trace proves items received, no acknowledge from HSBC. Claim filed.

The story:
1 letter requesting the statements sent 19/2. Statements received within 7 days. Letter written requesting the charges are returned. Chaser letter sent and they requested some further information from me (a breakdown of all charges with dates). This info was sent off and within 7 days and today (5/2) I received confirmation that they would refund all charges (tho do not admit they are unfair etc). They will refund all charges into my account if I agree not to take further action. My account has not been closed down.
I am thrilled. I have not had to go to court and all this took was 3 letters. If you have not yet begun this process please, please do. It could not be easier.
Martin, can I thank you from the bottom of my heart. I am just so grateful for your advice. I have been a subscriber for a couple of years now and find your tips very interesting and useful.

Did this one on behalf of my wife and had to go through to court stage again. There they disputed the amount of the charges I'd asked for (and in the end they were right - I hadn't allowed for the ones where they had already refunded them to her)
They made the offer of full payment (well what they calculated) well before the dealine day. However there was a snag. They claimed the account was still active and so paid the money into there. But with a debt collection agency having control of the account the account was inactive and should have had a zero balance (as I'd paid it off with the proceeds from my success against Halifax!).
They were refusing to pay me via cheque and had we have tolerated it being put into the account we'd have lost £346 to them for the balance. So I phoneed them, they insisted they were right and I said that if that was the case I would not accept their offer and allow the court to do it's worse.
Half an hour later the phone rings. They are prepared to pay me by cheque providing I don't want the account anymore. I said as a gesture of goodwill on my part I will waive my right to the £800 difference in the amount I was claiming and the amount they felt they should pay up. That's on the basis that the cheque arrives before Judgement day on the 10th.
They've accepted that. But it's not a giveawy from me. I rechecked my figures and discovered that the amount they said they owed was in fact what I made the total the second time around when it wasn't done late at nigth after a hard day at work.

The story: I had just over £5000 of charges from a couple of years ago they offered £4500 after just over one month and only 2 letters from me. It didn't even get to an official claim. I've accepted with great thanks!!

Refunded - Nil - 5 days left before I ask for court to enter judgment.
HSBC was easy. No reply to the first letter, but after 2nd letter sent threatening court action, they paid up swiftly, although they wouldnt entertain the idea of paying interest as well! As it was money that I never expected to see again, I took it.
NatWest - They were different. First off, I made the mistake of sending my claim letters to the same department that supplied my statements. First letter ignored, second letter still nothing, so I did a bit more research on this site and realised that I needed to send the claim letters to the head office in London. I typed another letter, explaining the situation, based around the template letters and also explained that I had sent them 2 letters previously, but to their office in Scotland. I gave them 7 days to reply otherwise I would be off to the local court to get my refund. They replied within the 7 days and by the end of the second week had offered me £2400. A very happy chappy, I took it! Moral of this story is - do not send your letters to Edinburgh office, but to the head office in London.
Monument - This lot have just completely ignored all the letters that I have written to them. So I did the decent thing and took out court action against them. They acknowledged the claim and so it gave them 28 days to get a defence together. On 11/2/07 their time is up, and I will ring to claim my charges back - WITH INTEREST - LOL.
To anyone out there still not sure about claiming charges back - Go for it, if I can do it anyone can, and with all the help on this site it makes it a very simple process. Tell your friends, work mates, and relatives - I have.
