Bank H.S.B.C
Amount claimed £1049... £1401 with interest!
Sent the 1st letter in December then the follow up letter on Jan 1st.
Then sent a 3rd letter threatening court action on the 19th Jan... Still heard nothing after 9 days so a polite phone call to them and they apologised for not answering within 5 days as per company policy.
Received a letter the day after offering £950 as stated that if I went to court they would win but dont want to incur court costs so will offer me that amount in a settlement although not admitting liability!
As I have a new baby I thought I`d take the £950 as offered.
Thanks to everyone involved what a god send this site is!!0 -
Bank: HSBS
Amount Reclaimed: £2776 - However, it transpired later that I asked for too much. Real amount £2177 inlcluding interest.
Amount they paid: £2168! HOOOOOORRRRRRRRRRRAAAAAAAAAAAAYYYYYYYY:beer:
The story:
I wrote to HSBC on 12th December. Gave them a little extra time as it was over xmas but only got a standard letter saying they were looking into it. So sent letter number 2 asking for £2776 again or would take them to court.
Didn't hear a dickie bird but again I let more time than I should lapse. (Difficult to keep track of time with a 2yr old and a newborn!) My darling husband then gave me a kick up the bum to file the court claim online on Tuesday 23rd Jan which i did at around 10pm. While I was doing this I realised that the amount that I had asked for was actually too much! - BY £900!!!!!- OOOOPPPPS!
The only thing that I can think I did was I had 1 charge for £100, when I was adding it all up, I must have added an extra 0 on the end!
So the actual amount that I should have been asking for, once the interest was added was £2177.
I duly filed the claim for this amount.
The next morning I got a letter from HSBC in reply to my first letter (12th Dec) offering me £2168.
As my post had arrived at 9.20am, and I am a stay at home mum, I was able to contact the court service and cancel my claim and got my £120 back!
I then signed my acceptance of their "offer" and sent it recorded delivery!
Got my money today!!!!!! YIIIIIIIIIIPPPPPPPPPPPEEEEEEEEEEEEE!!!!!
The bank are pleased because they think they've got away with making an offer! I'm pleased because for once my stupidity with numbers seems to have benefited me!
My account is still open and looking pretty healthy now.
I have been able to go out and buy some nice things for my baby daughter and as I have had to wait so long to hit the sales, things are now SUPER reduced!
This has certainly helped to blow away the January blues.
I am now helping my brother inlaw claim his may charges back form Natwest, HSBC, Capital One........
Thanks to everyone out there who took the time to post your stories - it spurred me on!:T :j

Amount claimed: Originally £400 but rose to £680 during exchange of letters
Amount paid: £680 + court cost + interest
Started a claim against BOS for £400 in November on behalf of my boyfriend, sent first letter and got standard 'sorry you're unhappy, we'll get back to you in a few weeks.' Sent 2nd letter - the LBA - just over 14 days later on December 12th and once again got a standard reply saying they'd respond by January 24th.
Filed at the Scottish small claims court on January 10th, got a letter next day by coincidence offering the original £400 claimed. Sent letter back saying we'd only take in part payment and had already raised court action for the whole sum.
Court documents weren't served till the 19th with a return date of Feb 22nd. Letter today (Feb 1st) offering full amount. Will cross out the full and final conditions etc and accept. Thanks to everyone who has posted on here, I am now helping friends reclaim!

Bank: Halifax
Amount Reclaimed:£450
Amount they paid:£300
The story: The charges were for £450 but £150 of that I hadnt paid as I was going through this procedure so technically I have it all back.
Sent my first letter on the 05/01/2007, second on the 12/01/2007 and received a phone call on Tuesday offering me £200, I said no was looking for £300. He said thats fine. ive signed a form, sent it off and waiting for a cheque now.
I really didnt think this would work. Didnt even need to start the moneyclaim. They were very helpful
ps I noticed that some people were looking for addresses to send letters to Halifax. Just send to your branch............it gets dealt with quicker that way0 -
HSBC
Claimed £3054 offered £3054! (includes interest)
Initial letter resulted in half the amount being offered which I declined. Entered claim using Moneyonline. Bank defended on 28th day... Completed court allocation form 2 weeks ago and was looking forward to being one of the 'first' in court. However, I'm delighted that this now isn't necessary and planning how to spend the money. Ironically, I don't need it now as totally solvent - but good to feel that the bank have to pay the money back because they treated me abysmally when I was really struggling.
Thank you for all the advice and support this site has given me.
p.s. the bank will not be closing my account, I've just beaten them to it!
Yippee!
p.s.s don't tell anyone, I'm meant to sign a confidentiality agreement. (Technically, I'm ok with this post because I haven't signed it yet ...!)0 -

Amount Claimed £10,000
Claim Settled £10,000
Halifax
Well, the difference in my story is, I'm a staff member. Requested bank statements, sent my letter in and waited with bated breath. Got a call from HO customer relations asking if I had "considered" the "implications" of taking my employer to court - when I asked her exactly what the implications might be in order that I could discuss this with my lawyer, she actually backed right off. After that I thought I might have a bit of a fight on my hands, I did loads of research, while she went away to consider an offer - she rang back about a week later and I told her I would not accept an offer of anything other than the full amount - she expressed her "disappointment" in my "failure to negogiate" and then promptly agreed to refund every single charge...Took around a month from start to finish and I'm a little disappointed that they rolled over and gave in without more of a fight, but the result was a winner !!!

It ain't over till the fat cat lawyer fails to turn up in court!
My modest success total to-date is £1,495 in six out eight of claims to date. Overall 25.1% of total losses.
Two claims are at the court stage: one I have an almost acceptable offer of £700, one (the big one) with no offer as yet but expecting it any day.
Five others (credit cards) all with various offers ranging from 28% to 100%. One other no reply as yet due for court action.
Rolling total no £22,002.37 - keep it going!0
