    I have two credit cards with Capital One, one VISA and one MASTERCARD. I have been using your template letters and i am claiming to include interest. (I used your interest calculater on the website). I have now recently had a letter back from both offering a settlement which is way below what i originally asked for. When it comes to the banks you say they may offer you a settlement but if you continue through the small claims you will eventually get back the full claim. Can this be done with a credit card?

    One card i claimed £1141.55 with interest, they offered me £348 and the other i claimed £594.80 and they offered £232.

    They did send a polite letter saying why the fees are charged i.e. late payment or over your limit. Also they explained that i had a credit card agreement which i signed stating that i would agree to the Terms and Conditions.

    They went on to say they believe a £20 fine is fair and lawfull but reduced it to £12 to be in line with competitors.

    They appreciate ive incurred fees at the higher rate and as a matter of goodwill all the old fees that were charged @ £20, were reduced to £12 and the difference refunded to me above.

    At this stage with the banks you say go through the small claims to get the rest of your money. Will i be able to do this? I think the settlement is far too small to agree with

    You can't apply for any judgement at this stage (don't press any buttons). Just sit and wait now. It will probably say 'acknowledged' next (within the next week or so), and give the bank a bit extra time to enter a defence.

    Yes. It is exactly the same process.

    If you have sent both letters to the company asking for repayment of the charges, and already given them notice you will issue a court claim. Then go ahead and start your claim. It may be very daunting, but the success rate is excellent.

    Update, sent initial 14 day letter got usual reply sorry you're unhappy but tough luck so sent 7 day letter, havn't heard anything so now time for the court letter, but reading the template letter asking for figures do I update the charges because of the interest since starting the claim or send the original figures and they will be updated automatically. Any help will be greatly appreciated, and do I send the letter to the same address recovery centre in andover or a head office address.

    Send the original figures with this letter. When/if you issue a court claim, re-enter your charges in Martins calculator to get updated figures.

    Reply to the address that sent you the refusal letter.

    The one in step 4 of Martins article giving them 7 days to respond, or you will issue a court claim.

    That is the last one I sent 7 days was up yesterday heard nothing from them whatsoever

    I applied for a refund of £275 and got a letter saying a full refund was being given :)

    Thanks to this website, as without it I defo would not have gone ahead and done it. i wonder is it worth trying this with my Irish Banks also ?

    Amount Back: £1,000

    Intially said no to my claim, but then when I said I'd have no problem with going to court and adding interest they offered me £500, I said no to that as I didn't feel it was fair enough then they offered me £1,000 so I took it!

    Currently £42,000 in debt :eek: could no longer cope, contacted CCCS :A and now I'm working to sort everything out :D a long road......but worth it!!!
