I am about to serve Court papers to the following, Sainsburys Bank plc,.,
Tesco Personal Finance and Halifax Card Services Visa.
Tesco Personal Finance is a joint venture between them and the Royal Bank
of Scotland, so where do I send the Court Papers. Sainsbury's Bank has
a Registered Office in London so I assume the papers will be served there.
Halifax Card Services is run from Dunfermline (as is Sainsburys), but, do I send
the Court papers to Halifax registered office.

    I would appreciate a reply.

You must send the court papers to the bank's registered address. I think you'll find that Tesco Personal Finance is nothing to do with Halifax.
  • Hi
I have finally recieved my bank statements from RBOS after 70 days, 1 data protection letter and 2 calls later.I have worked my charges out using the calculator and charging interest. Total £3832.18.My bank claims it took so long because i posted it too my local branch and not their head office. They say they don't accept mail unless addressed to a specific person at the branch,so should i address my claim letter for a refund to the bank manager.

I have dealt with multiple banks, writing at every stage to the local branch. It has never been a problem for any of the banks to forward the mail on to the relevent department. Address the letters to the manager, if he doesn't know what to do with the letters, none of his staff will know. If you give them a timetable in your letters (14 days etc) stick to it. If they say they will reply after X amount of weeks, press on with your own deadlines.

  • thanks Martin, you made me think it was not just possible but probable.

    amount claimed £800
    amount owed £1049
    amount paid £1049

sunbject access request sent, calculations made, letter to Smile reclaiming charges sent off. Asked for £800 as we like the 'ethical' (well better than some) stance gave them 14 days and they paid up in full. Banking relationship intact.

cannot thank you enough, most of the charges relate to when i was made redundant. great to get it back. :money:
  • Bank: MBNA
    Amount Reclaimed: £14.74
    Amount they paid: £13.11
    The story:
I was charged a £25 late fee one month when I didn't receive my statement.
I complained at the time, and MBNA refunded half the fee.

I wrote to them on 20/12/2006 demanding the other £12.50 and £2.24 interest.

I received a reply dated 27/12/2006 saying they would send a full response by 17/01/2007.

They sent me a letter dated 17/01/2007 saying I'd get a full response within 10 working days.

I then received a letter dated 25/01/2007 setting out why they tought they were right and I was wrong and promising a "goodwill payment" of £13.11 by cheque.

Well worth the cost of a stamp to write to them, anyway.

  • Bank : Lloyds TSB
    Reclaimed:£585.00
Amount Paid: £585.00 plus a further £90.00 charges waived.

Less than 4 weeks since starting the claim and despite receiving a letter which stated they would not pay, I had notification that in fact they are re-imbursing the full amount straight away.

Interesting line in the letter which stated; 'we are making this offer because the amount you're asking for is less than the cost we might face in dealing with your complaint if you took it any further'.

To me this sounds like an admission that they could not win.:T

    Thank you very much!

  • Bank: First Direct
    Amount Claimed: £1856.87
    Offered & Accepting: £1282.00

Read on this thread somewhere that you could only claim Excess O/D Fees and not O/D Fees as well, but decided to chance my arm anyway, and claim both. The Excess O/D Fees alone (incl interest) amounted to £870.19, which is what I was hoping to get back, so was delighted when the letter arrived yesterday offering me £1282.00, which as I see it, isn't £600 less, but nearly £500 more than I had hoped for, and nearly £1300 more in my bank than I would have had, if I hadn't claimed at all. And they sent back my £10 cheque for the statements, and included my Christmas O/D Fee in their calculations.
