    HSBC - Amount Claimed £543.

    Followed steps on this site and sent template letters etc.

    Sent 1st Dec 12th Letter requesting payment after I made my own calculation from my online banking statements. Recieved a letter 10 days later saying that they were looking into the matter.

    Sent 2nd Letter after 14 days and recieved another letter requesting that I send them a letter listing the charges and dates etc (My original letter to them was only one page and it had all the charges listed on it in the format they requested so I do not know why I was sent this letter)

    I phoned HSBC regarding the matter on Jan 14th regarding this and they fobbed me off saying that they had 8 weeks to reslove the matter before the Ombudsman was able to investigate etc etc.

    I was going to start my court process of this monday when I got paid but I recieved a letter today stating that they would offer a settlement of £500 so I have accepted.

    I am about to serve Court papers to the following, Sainsburys Bank plc,.,
    Tesco Personal Finance and Halifax Card Services Visa.
    Tesco Personal Finance is a joint venture between them and the Royal Bank
    of Scotland, so where do I send the Court Papers. Sainsbury's Bank has
    a Registered Office in London so I assume the papers will be served there.
    Halifax Card Services is run from Dunfermline (as is Sainsburys), but, do I send
    the Court papers to Halifax registered office.

    I would appreciate a reply.

    I sent my bank (the Halifax) the second template letter requesting my charges plus interest for a total of £2373 on the 2nd Jan.

    I recieved a phone call this afternoon, from the bank asking if I would be happy to accept £1200. Naturally I said NO. I was then offered £1500, I refused this figure as well. I stood firm and suggested that I would be happy to settle at £2000.00 to which after a little thought, they agreed and apparently the money will be transfered to my account within the next 10 days.

    I just want to say a big thank you to all at the Money Saving Expert site and Martin.... with out you all I would not have the courage to go through this process.

    Amount claimed 1000 plus costs
    Amount paid 1000 plus costs

    Followed recommendations on this site for claiming, bank wrote and said they wouldnt pay. Bought Lawpack, read up on how to claim, then filed online claim. Yesterday had acknowledgment from court saying bank defending claim, this morning had letter from bank saying they had credited my account for full amount claimed! Thank you so much to everyone on this site for giving me the courage to do this (I can now replace my kitchen window!). My OH is now going to do the same with his bank... will keep you posted.

    Claimed : £2564.50
    Offered and accepted : £2160

    Wrote to FD asking for money back using the template on this site. Received an offer of £2160 which is 85% of the claim. I've decided to accept as I've got other fish to fry now (RBS and HFC credit card charges).

    No mention from the bank of signing a confidentiality clause or closing my account.

    Massive thanks to this site and everyone on it. As well as getting this money back I've trimmed about £100 off my monthly outgoings thanks to everyone at MSE :)
    Bank charges reclaimed:
    £2160 - First Direct
    £415 plus court fee - HFC Credit card
    £409 + costs + 8% interest RBS Credit card
    PPI reclaimed:
    £12541.82 from First Direct.

    £436 + £48 interest claimed.
    £436 'goodwill gesture' accepted.

    I used the templates on the site and obtained 6 years of statements for £10.
    I sent the first letter to my branch recorded delivery on the 28th December and the 'letter before action' recorded again on the 18th January.
    Received my first response with an offer of £436 yesterday.

    Many thanks to Martin and the posters on these boards, particularly Edinburghlass and Rex Mundi whose advice to others was invaluable to myself as an observer.

    For anyone thinking about doing this, get stuck in, read the article carefully and if you have a question it will almost certainly have been answered somewhere on this board. Finally, its worth a £1 a time to send your letters by recorded delivery.
  • Can anybody help me? I'm at the stage with the Bank of Scotland where they've offered me settlement of half of £600 charges, and i'm prepared to take them to court. I live in London - but do i go through the Scottish or English court?

    Dear Money Experts

    First Direct Current Account- Pls help- I followed your instructions with the letter, received the bank statements for last six years and wrote to First Direct to re claim all charges with interest approx £3,000.

    Just received a letter back from them offering me £906, and stating that they are confident of their position if I proceed to court they would resist any legal challenge in relation to these fees. They refer to their terms & conditions when I opened the account over 6 years ago.

    NOw I am doubting whether what I was claiming for is correct. Charges and late payment fees, overdraft fees etc. THe offer of £906 is only available for 10days from 8th Jan but I have been away until 20th on business trip- so missed their deadline- What do I do??Should I accept?

    First Direct Credit Card
    They state in the letter that First Direct has carefully considered OFT publications and does not accept them. HOwever fro future they are reducing the cost but are not paying up on my claim and offering a fraction £135.00!

    Halifax Credit Card-

    Stated late payment/over limit charge of £25 was applied when my minimum payment not received by due date and as such will not refund any money! they refer to original agreement

    So I am at a loss of what to do and if I should just accept First Direct offer?
    and call it quits?

    Will await any advice

    As you haven't accepted, you have in effect refused so must now carry on to court if this offer is their reply to your letter before action.
