    The story: My claim only took the first letter to get my money back, although it did take longer to get a reply than the 14 days to get a reply (took 6 weeks) but it was over the christmas period so i gave them a couple of weeks grace. i'm really pleased with the result, thank you Martin and thank you to my friend who introduced me to the site.

    Offer: £882.00 exc overdraft interest and statutory interest of 8%

    Actions:

    3 Jan 07: Sent first letter requesting repayment of charges as above
    15 Jan 07: Acknowledgement of letter saying will contact as soon as investigations complete
    19 Jan 07: Received offer letter for £882.00

    Will accept this offer as, like some others, I sort of agree that they are entitled to charge something ref mismanagement of my own account. Also don't think I could cope with the worry of potential flurry of correspondence and resultant court appearance.

    Just so so so very grateful to all those who have spent time and effort in putting together the information on this website and for keeping it maintained with up to date information.

  • I have an offer to refund bank charges which I will accept. However, my account is still open with just a £2500 overdraft - less than the bank charge repayment of c£800.

    Can HSBC just deduct the refund from my overdraft amount by crediting it to my account (ie I do not get to choose how I spend my refund) or do they allow you to draw it out.

    I realise they probably can in theory but is it legal/correct for them to do so without agreement?

    Would appreciate your comments, although I think I probably know the answer. It would however be good at the moment if there were a legal loophole to somehow keep the money and to be able to pay for something unexpected which has just happened.

  • I have just recieved an offer of HSBC of £475 for the owed amount of £558 with intrest this amounts to £633, should i accept this amount as i believe they are just trying to save themselves £150 and if i don't accept ot do i just write another letter refusing it stating what i will accept or that i will see them in court. Is there a template for this final piece or do i just file a claim with the court and then let that process contact the bank! help me!!!!

    No.1 not sure, it should be a different agreement but....

    No.2 you can claim back six years from the time you ask for the statemnts/info. If you get any more charges while you are going through your claim you can add them on at the last minute if you start the court proceedings at MoneyClaim.

    The banks are not obliged to include the interest in any offer as this is only applicable when/if it gets to court so really they are offering you £85 less so it depends if you think its worth carrying on, your decision I'm afraid.

    You would then have to file a claim at MoneyClaim.

    They are not saving themselves £150. They are making you an offer that is £83 less than you are entitled to at this stage.

    Untill you actually issue a court claim, you are not entitled to the interest. All you are entitled to claim at this stage is £558. Their offer is 85% of your claim. This isn't a bad offer, but it's your choice whether you accept or not.
