    They wrote back offering me £399 as I had already had some of the charges refunded (true) plus I'd claimed for a charge with was 'non-refundable' (was worth a try), which took the final figure to £399 - the full amount that they really owed me.

    I signed the acceptance letter but deleted the part where it said that they would pay the amount into my first direct account (I've just opened a new account with Alliance and Leicester and want to pay the money into that account) and attached a letter stating that I wanted my claim to be paid by cheque, and that I would instigate court proceedings if they didn't send a cheque within seven days.

    Cheque for £399 received today

    Thanks MSE for publicising this - I'd like to make a small donation to a charity of MSE's choice just as a way of thanking you for giving me the courage and assistance to pursue this - please advise?

    I sent in a letter and a schedule of charges using the template from this website. I got a generic 'we are sorry you are unhappy' letter which said they would contact me within 7 days. They didn't, so I sent another letter enclosing copies of correspondence. I followed this up with a phone call.

    £260 appeared in my account within another 5 days!

    This was a lot easier than I thought it would be! I was prepared to threaten court action but happily it didn't come to that. Definitely worth doing, thanks MSE for help and inspiration!
  • Well my story seems uninpressive.
    I sent a letter last Thursaday, to FD and asked for Charges back. I under calculated and sent the wronge amount. About £300 short, but alas my error.
    I received a letter today one week later saying they will give me the amount I asked for, a long with the usual its your task to keep you bank account up to date ect. Letter has now been posted and I am awaiting the money. I don't mind it's not what I asked for, but at last I can pay my overdraft and change bank accounts.

    Received my letter this morning (along with a bunch of bank charges leaflets!).
    The letter stated that while NatWest did not agree with the basis of my complaint and that their charges were fair and transparent they would offer as goodwill £179 - which was the amount I had been charged in the first place. So no interest but my money back. I'll accept as I don't fancy going through the small claims court for £80 - I live in Scotland and would either have to go the system here which would only include charges 5 years old or travel down south to use a court in England and so I'd just have to fork out on airfares.

    Thanks to Martin though - great site that constantly pays off.:T
    If anyone is having doubts over whether to go ahead - its a no brainer!

    took less than 2 weeks from sending first letter requesting refund on the 11th got the funds today ;-)

    got the same responce "we dont agree with the basis of your complaint and without admission of liability or error bla bla bla as a goodwill gesture we will offer you the full amont"

    did say however if we incur any charges in the future they would consider removing the lending from the account or possably close the account.

    Martin your a star big ta to everyone on the site it just shows what people power can do ;-)

    All banks can and some do close accounts or withdraw overdraft facilities so it is best to have another account set up as you start claiming. You can start the claim now by asking for all the information and at the same time look for another account.

  • On my old Barclays Account, I had a £2k overdraft.. Mostly made up of bank charges. The claim I put in (including interest) was just short of £7.5k. However, they have offered me £700 to be paid off the o/s balance (debt was passed to a Debt Collection Agency and subsequently being paid off) still leaving me with £1800 approx to pay. I am paying monthly to reduce this amount further though.... As the debt has left "their" hands then are they right to reduce the payment owing?

    What should I do?? Accept £700 in part settlement and pursue the rest? Or leave it?
  • dear helena35, should you accept the offer or not is your choice,no reason why you shouldnt as long as you make them aware you see it as part payment only,then continue your claim,good luck.
