Amount received = 670
I tried to claim with interest and they offered me the amount without interest. I happily accepted.
My wife claimed without interest and they paid full amount.
I had to resort to letter B and threaten small claims court but my wifes was accepted from letter A.
Thank you so much Martin for providing the letters and the advice to go through with this claim, I was very sceptical as to whether this would work so I both my wife and I are very happy to have recieved some quite large sums.
Halifax have not closed our accounts but have stated that as part of the settlement we cannot make any future claims.
They have been very polite, forthcomming and promt in respones to our letters.
A good result and I would reccomend any one to try this.

All banks can and some do close accounts or withdraw overdraft facilities so it is best to have another account set up as you start claiming. You can start the claim now by asking for all the information and at the same time look for another account.0

Hi,
sent our first letter off to HSBC 2 weeks ago with list of charges. All ready to send out second letter when a letter from bank came in post this morning.
It says, "in order that we can consider your request please provide a full itemised breakdown of these charges." They give suggested format of:
Date Amount Description
dd/mm/yy £xx.xx As appears on statement
Total
£xx.xx
We sent our list as follows:
Date Unauthorised overdraft(£) Unpaid/represented cheque(£)
Total Total
Grand total
Have we messed up or does the format not matter? Why have they acted like we never sent them a list of charges? On the statements it just said DR or total charges but they were for going over our overdraft; should we have put DR instead? Should we send the letter again with a new list of charges? Are they just messing us about? HELP!! Don't know what to do now!!!

The story: Took a while but they were actually very helpful and for this reason I decided to accept the lower amount of £1400, and I didn't fancy going to court much. Now on the case wth Lloyds TSB who are proving to be far less helpful...0 -
More HSBC incompetence, my employer changed our pay date late last year. I went into the bank to change all my standing orders and d/d's now they've somehow taken all my bills out 2 days before I get paid so I get stung yet again with charges due to their incompetence, can I claim for some kind of compensation as well as getting the charges back as this is gross incompetence on the banks part. I rang up their customer services (HSBC btw) and was told the new date is showing (the 1st of the month) and they don't know how or why the money has left my account. I changed all details as soon as we were informed here at work in the first week of January so they've had over 20 days notice. Where do I stand?0

Hi,
Ive just received a letter from Capital One saying that they will refund me £88. Ive asked for £220. There was 11 charges of £20 so the bank have taken £8 of each charge to bring them all down to £12 each. Can I still get the money back even though the OFT say they should charge £12.

offered : £2500 (as they deemed claiming the interest a bit "inappropriate")
I kind of agree, and am chuffed to bits with the offer.............!
It's £2500 I didn't have last week!

Amount they paid: £4000
The story: Very straightforward (if slightly drawn out process). Wrote to the bank, requesting refund. Acknowledgement letter came a month and a half later. Offer letter of £4000 arrived a week later. Signed, sealed, delivered! No courts involved, didn't bother with solicitors etc. Usual story statement about they believe their charges are lawful, but don't want to enter into a legal battle with associated costs etc.

Yes, you can carry on the claim. The OFT said the maximum a charge can be is £12, but this doesn't mean that £12 is a fair charge, and the banks shouldn't just charge the maximum allowed. Only a court can decide whether this is fair. I would carry on, chances are they will not want to go in front of a judge, and will settle before this.How many surrealists does it take to change a lightbulb?
